Alexander McAlexander to John Matthews

 

 

This indenture made this 2nd day of June 1818 between Nathan Montgomery of the County of Adair & State of Kentucky as attorney in fact for Alexander McAlexander of Nelson County Virginia, of the one part & John Mathews of Washington County Kentucky of the other part witnesseth that the said Nathan Montgomery as attorney afsd [aforesaid] for and in consideration of the sum of three hundred and seventy five dollars to the said McAlexander paid the receipt of which is hereby acknowledged hath given granted bargained & sold & by these presents doth give grant bargain sell & convey unto the said John Mathews a certain tract or parcel of land containing three hundred acres situate lying and being in the said County of Adair on the North Fork of Caseys Creek and bounded as follows, viz, Beginning at William Montgomerys corner at a gum and beech thence North 50E212 poles to two sugar trees in the head of a hollow thence North 40 W 235 poles to a poplar & hickory an a ridge thence S 50 W 196 poles to three dogwoods and a large spanish oak corner to said Montgomery thence S 36 E 236 poles to the beginning it being the upper part of a 600 acre survey held by said McAlexander with all & singular the premices & appurtenances thereunto belonging to have and to hold the said 300 acres of land be the same more or less with its appurtenances unto the said John Mathews his heirs and assigns forever to his & their only proper use benefit & behoof the said Nathan Montgomery as attorney of and for the said Alexander McAlexander doth covenant and agree to and with the said Mathews that he will warrant & forever defend the said tract of land with its appurtenances unto him said Mathews his heirs & assigns against the claim or claims of said McAlexander & his heirs & all & every person or persons whosoever claiming the same under the said Alexander McAlexander in testamony where of the said Montgomery as attorney of afsd hath here unto set his hand & seal the day and date above mentioned.

I William Caldwell Clerk of County Court for the County aforsaid do certify that on the day of the date of this certifcate came before me in my in my office Nathan Mongomery attorney in fact for Alexander McAlexander and acknowledged the within indenture of bargain and sale to John Mathews to be his act & deed and that I have recorded the same together with this certificate in my said office as required by law witness my hand the 2nd day of June 1818.

John Matthews- Sale of Property for Estate Purposes

 

This indenture made this 4th day of October 1824 between John Grissom Sheriff of Adair County and State of Kentucky of the one part and Sampson Caskey and Josiah Beard of the same county and state of the other part witnessth that whereas William Patterson Deputy for the said John Grissom Sheriff as aforesaid did on the 16th day of July 1824 expose to public sale a certain tract or parcel of land situate lying and being in the County of Adair and State afs on the north fork of Caseys Creek, containing three hundred acres to satisfy an execution of fieri facias, in favour of the Commonwealth Bank and against the Estate of John Matthews for the sum of $225 besides interest & costs bearing date the 25th day of March 1824 and numbered in the Clerks record book 11 directed to the Sheriff of Adair County, which execution was duly [levied] on the said tract of land as the property of said Matthews and the time and place of sale of said land was duly advertised as required by law and the said Caskey & Beard became the purchasers thereof at his the highest bid of two hundred seventy seven dollars and seventy five cents at three months credit the receipt of which I do hereby acknowledge.  Now this indenture further witnessth that for and in consideration of the premises the said Jno Grissom as Sheriff as aforesaid doth by these presents convey and transfer unto the said Sampson Caskey & Josiah Beard their heirs and assigns the aforesaid tract of land situate on the North Fork of Caseys Creek as aforesaid and bounded as follows towit.  Beginning at William Montgomerys corner to a gum and beech thence North 50 East 212 poles to two sugar trees in the head of a hollow thence N 40 o W 233 poles to a poplar and hickory an a ridge thence South 50 W 194 poles to three dogwoods and a large Spanish oak corner to said Montgomery thence S 36 E 230 poles to beginning to have and to hold the said land with its appurtenances to the said Caskey Beard their heirs and assigns to their only proper use benefit and behoof all the rights and title which the said Matthews may have in and to the said tract of land in testimony whereof the said Grissom as Sheriff aforesaid hath hereunto set his hand and seal the day and year aforesaid.

            I William Caldwell Clerk of the County Court for the aforesaid County do hereby certify that John Grissom Sheriff of Adair County party to the within indenture from himself to Sampson Caskey & Josiah Beard came before me in my office and acknowledged the within indenture to be his act and deed and that I have recorded said indenture & this certificate in my office as required by law witness my hand this 12th day of November 1824.
