Will of S. Rubards dcd.
Be it remembered that I Samuel Rubard of the county of Casey and state
of
Kentucky considering the uncertainty of this life and being of sound and
perfect
mind and memory Blessed be Allmighty God for the same do make this my
last will
and testament in manner and form.
First I give and bequeathe to my two grand daughters Mary Jane Edwards
and
Avalina Edwards heirs of my dcd daughter Avalina sole wife of Jacob
Edward one
certain tract or parcel of land laying in Casey County. Beginning near a
spring
thence down the spring branch including the spring so fare that a line
will
sprike a line of my 212 acre survey thence with a line of the South 13
degrees
West and passing the corner to two Black oaks and poplar corner of a 100
acre
survey thence with a line of the same N 66 degrees W 77 poles to two
Beeches
thence N 13 degrees E 106 poles to two hickeries thence to Langhorn
Edwards
corner a hickery thence with an agreed line between myself and Langhorn
Edwards
so fare that a line south will strike the beginning at the spring said
land to
be equally divided between them.
I also give and bequeathe to my son Vincent Rubards one certain tract or
parcel of land on which he now livs it being laid of and the lines
marked by
Thomas Miller and William Rubards.
All the ballance of my estate I give to the ballance of my children. I
give and
beqeathe to my son William B.Rubards one fifth land of said ballance of
my estate.
I give and bequeathe to my son Edmon H. Rubarts one fifth of the
ballance of
my estate.
I also give and bequeathe to George W. Rubarts three children (court)
Thomas M.
Rubarts Margaret Rubarts and Samuel Rubarts jointly one fifth part of
said
ballance of my estate.
I also give and bequeathe unto the heirs of my daughter Lasuhama Dcd
late
wife of William Ennis one fifth of the said ballance my estate to be
equally
divided between them.
I also give and bequeathe to my daughter Cinthia Miller one fith part of
said
ballance of my estate.
I do hereby constitute and appoint Robert Carson and BCN Allen my
executors
to this my last will and testament revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this 8th day of
April
in the year of our Lord Eighteen hundred and forty seven.

Casey County
At a county court held for the aforesaid County on the 2nd Monday in
July 1850
the foregoing writing was produced to the court and by the oath of James
Allen
and Stephenson Whitaker witnesses thereto was proven to be the act and
deed of
Samuel Rubarts Dcd and ordered to be recorded and probate thereof was
granted
to BNC Allen and Robert Carson.
