To the Surveyor of Clinton County by this shall begin a Warrant to lay off and survey for THOMAS BYBA One hundred acres of Vacant Land in Clinton County Ky he having produced before the County treasurers receipt for $3 Having Given under my hand this 23rd day of March 1846

To all to whom these Presents shall come, Greeting: Know Ye, that by virtue and in consideration of part of a warrant from the Clinton County Court, there is granted by the said Commonwealth, unto MICHAEL BROWN, assignee of WILLIAM WOOD, assignee of THO. BYBEE a certain tract or parcel of Land, containing fifty Acres, by survey, bearing date the 19th day of August one thousand eight hundred and forty six lying and being in the County of Clinton on the head waters of the Caney Fork of Wolf river and bounded as followeth towit: Beginning at a chestnut oak where a stake is called for as BROWNS Corner thence N56 E50 poles to an ash and cucumber then N50 poles to a stake on the County line of Wayne County then with said line W60 poles to a large chestnut the corner of said County then with a line of the same N50 W67 poles to two white oaks corner to said County then with the same N6 W50 poles to a stake on said line then S68 W38 poles to a stake on MALINDA SHELTONS line then with her line S38 E50 poles to a sugartree her corner then with a line of the same S30 N28 poles to a Sugartree and pointers her corner then with a line of the same S77 W20 poles to a large poplar and buckeye her corner then with a line of the same S6 N60 poles to a sugartree hers and MICHAEL BROWNS Corner then with said BROWNS Survey N85 E35 poles to a poplar his corner then with his line N15 W56 poles to a poplar and sugartree his corner then with his line N81 E25 poles to a cucumber his corner then with his line N58 E2 poles to a stake and pointers his corner then N77 E6 poles to a white oak and maple his corner then with his line S27 E65 poles to two elms about 12 poles S.E. from the Spring his beginning corner then with his line S30 E45 poles to the Beginning

    With its appurtenances: to have and to hold the said tract or parcel of Land, with its appurtenances, to the said MICHAEL BROWN and his heirs forever. In Witness Whereof, The said WILLIAM OWSLEY, Esq., Governor of the Commonwealth of Kentucky, hath hereunto set his hand, and caused the seal of the Commonwealth to be affixed, at Frankfort, on the 5th day of July in the year of our Lord, one thousand eight hundred and forty seven and of the Commonwealth, the fifty-sixth.

NOTES: Michael Brown (b. abt. 1808 TN – d. Mar 01, 1858), Clinton Co., KY) married Elizabeth Shelton (b. abt. 1815 TN – d. between 1870-1880 KY?), and they produced ten children. Michael was on the 1830 Fentress Co., TN Census, the 1833 Enumeration of Male Voters in Fentress Co., TN, and the 1840 Jackson Co., TN Census. He was on the 1850 Clinton Co., KY Census, next to Issac Shelton. His widow, Elizabeth “Betsy” Brown, was on the 1860 and 1870 Clinton Co., KY Census. Their graves and place of burial have never been found. Their children were: Sarah (b. abt. 1830 TN); William (b. abt. 1831-1832 TN or KY) md. Ary Ann Young; Mary (b. abt. 1834 TN or KY); Amanda Jane (b. May 8, 1833 TN or KY) md. Martin Rigney; Enoch C. (b. abt. 1836-1837, Jackson Co., TN) md. Mrs. Sarah Ann (Jennings) Jones and Mrs. Louisa (Shelton) Keith; Elijah (b. May 3, 1843, Jackson Co., TN) md. Jane Bertram; John Matt (b. abt. 1843-1846, Jackson Co., TN) md. Mary Jane Fletcher; Rosena (b. abt. 1846, Fentress Co., Tennessee) md. Seaton Ezekial Shelton; Eli H. (b. Oct. 10, 1849) md. Nancy Smith & Mrs. Lizzie (Davis) Pennycuff; Thomas Jefferson (b. January 15, 1852, Clinton Co., KY) md. Ila Shelton.

The Land Records for the period between Michael Brown’s death in 1858 and the burning of the Clinton Co., KY Courthouse in 1865 were lost, so we do not know the full story of the disposition of Michael’s land. However, on August 28, 1874 ELI BROWN sold land to GEORGE SHELTON which appears to have been all or part of the land grant that had belonged to MICHAEL BROWN, representing eight shares. (Clinton Deed Book D, Pages 240-241)

“For and in consideration of the sum of fifty dollars to me in hand twenty six dollars and the rest due February 10th paid bi GEORGE SHELTON I ELI BROWN have this day Bargained sold relinquished and delivered unto the said GEORGE SHELTON all my right -- title and interest – to and into a certain tract or parcel of land being and being {sic.} in the county of Clinton and State of Kentucky on the head waters of Cana fork creek and Bounded as follows Beginning on the old tract and running with the cors (corners?) so as to include eight Shers in the tract of land I ELI BROWN do agree to Warrant and defend the absent title unto the Said GEORGE SHELTON and his heirs and assignes against my self my heirs and against all the claim what so ever given under my hand this the 27 day of august 1874” (Deed Book D, Page 240)

“State of Kentucky – Clinton County – I J.H. BRISTOW Clerk of the said county court do certify that on the 3rd day of May 1875 the foregoing deed of conveyance from ELI BROWN to GEORGE SHELTON was proved before me by the oaths of J.S. GUINN     JOHN SHELTON the subscribing witnesses thereto to be the act and deed of said ELI BROWN for the purpose therein mentioned and the same having been lodged in my office for record I have duly recorded it together with this certificate in my office Given under my hand this 10th day of May 1875 J.H.
