Court Orders Written: April 12, 1813 Hardin County Court Bk C, pp 69 - 76 Monday April 12th 1813 At a County Court began and held for Hardin County on Monday the 12th day of April 1813 at the Court house in Elizabeth Town Present Nicholas MILLER Christopher MILLER George HELM and Arthur McGAUGHY Esquires -------------- The persons appointed to view an alteration proposed to be made in the road leading from Elizabeth Town to HOUCHINs ferry this day made the following report towit In obedience to an order of the County Court of Hardin County to us directed for to view an alteration in the road leading from Elizabeth Town to John HOUCHENS ferry on Green River do make the following report that we have carefully viewed the old road and the new proposed way do think in our opinions that by leaving the old road about one half mile from Enoch BUTLERs toward Elizabeth running past said BUTLERs house thence to intersect about the same distance after passing said BUTLERs with the old road would be of great advantage to travelers as there is a g__d house for entertainment the ground on which the proposed road passes is much the best but perhaps the old road may be a few poles the nearest but in our opinions greatly injures the farm of said BUTLER given under our hands this day of 1813 Priday MEEKS, S aml FINLEY John SMOOT which alteration is hereby established and the surveyor of said road is hereby required to work on said road agreeable to the above repot. --------------------- Ordered that the following hands (towit) Aaron DART John HART George REINBARGER Reubin NEWTON Peter ROMINE Jesse KERBY John ASHBAUGH and Joshua GLOVER do assist John BUCKLES Surveyor of the road from the mouth of the valley creek to the _____ of _____ keeping said road in repair -------------------- An Inventory of the appraisement of the estate of Christopher BUSH deceased was produced in Court and ordered to record. --------------------- The Commissioners appointed to settle with the administrator of the estate of John FORBILE and distribute the said estate among the heirs thereof this day made their report which was ordered to record -------------------- Ordered that Joseph STITH William B. STITH James WILSON and Christopher WILSON or any three of them after being sworn before a magistrate of this County do view an alteration proposed to be made in the road leading from Elizabeth Town to BRANDENBURGs ferry and that they report whether said alteration will be of utility or not to the public also the inconveniences and conveniences of the old road and the way proposed ------------------ On motion George McLEAN and it appearing to the satisfaction of the Court that Nancy McLEAN widow of Leonard McLEAN deceased has relinquished her right to the administration of her husbands estate, the administration of the estate of the said Leonard McLEAN is granted the said George McLEAN who took the oath required by law and entered into and acknowledged his bond with John MILLER Enoch BUTLER and Lewis WELLS his securities in the penalty of one thousand Dollars conditioned as the law directs. ----------------- Ordered that Samuel FINLEY William JONES Samuel WELLS and Thomas ATTEBERRY or any three of them do after being sworn before a magistrate of this County appraise the personal estate and slaves if any of Leonard McLEAN deceased and make report to Court ---------------- Henry WIN came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand Dollars conditioned as the law directs with John CRUTCHER and Jacob DUFNER his securities after having taken the oaths required by law. ---------------- On motion of Enos HARNET the administration of the estate of Jonathan HARNET is granted him whereupon the said Enos HARNET came and entered into and acknowledged his bond in the penalty of one hundred Dollars with Nathaniel HARNET his security conditioned as the law directs. ------------------- Ordered that Benjamin STITH Joseph VERTREES Jacob HARTLY and Thomas DUVALL or any three of them after being sworn before a magistrate of this County do appraise the personal estate and slaves (if any) of Jonathan HARNETT deceased and make report thereof to next Court. ------------------- This day Polly and Ruth YOUNG infant orphans of Adam YOUNG deceased came into Court and being permitted by the court chose Nicholas MILLER for their guardian, whereupon the said Nicholas MILLER came in and acknowledged his bond in the penalty of Eighty dollars conditioned as the law directs with George HELM his security -------------------- John HODGEN paymaster to the 60th Regiment of Kentucky Militia came into Court and Renewed his bond in the penalty of five hundred dollars conditioned as the law directs with Samuel LARUE and George HELM his securities ------------------- On motion of Moses THOMAS who holds a bond on Thomas HARGIS for 300 acres of land a part of a settlement and preemption of JERRITS where the said HARGIS lived and the said HARGIS only having a title for 200 acres the title to the other one hundred acres being in Zacheriah DEWIT and it also appears that the said DEWIT and HARGIS are both paid by said THOMAS for their respective part, It is ordered that Anthony NEWMAN James EDLIN and George HELM be and they are hereby appointed commissioners to convey the said land to Moses THOMAS by Deed on the part of the said HARGIS and DEWIT --- ---------------- Ordered that James BROWN be and he is hereby appointed Surveyor of the same road which John COY was surveyor of and all the hands that did assist said COY do assist said BROWN in keeping said road in repair --------------------- Ordered that Joseph TODD be and he is hereby appointed guardian to William TODD and Jesse TODD he the said Joseph being chosen by them whereupon the said TODD entered into and acknowledged his bond with John ASHCRAFT and William CESNA his securities in the penalty of five hundred Dollars conditioned as the law directs ----------------------- Ordered that Joseph TODD, John McDOUGLE Shadrick DUNCAN and Taylor BEARD or any three of them after being sworn before a magistrate of this county do view an alteration proposed to be made on the road leading from HODGINs mill to green town and that they report whether said alteration will be of public utility or private convenience and that they report the conveniences and inconveniences attending the same. -------------------- Ordered that Squire LARUE John McDOUGLE William CESNA and Charles FRIEND or any three of them do after being sworn before a magistrate of this county view the nearest and best way for an alteration to be made on the road leading to the level woods to leave the old road against Isaac FRIENDs and Intersect the same against McDOUGLEs field and that they make report to court --------------------- Ordered that George HELM be and he is hereby appointed an additional commissioner to divide and convey non residents lands --------------------- Charles HELM paymaster to the 3rd Regiment of Kentucky Militia this day came into Court and renewed his bond with Robert HUSTON and Jacob VANMETER his securities in the penalty of five hundred Dollars conditioned as the law directs ---------------- Reubin GRAY is appointed guardian to George GRAY William GRAY John GRAY and Jeptha D. GRAY infants & orphans of Joseph GRAY deceased. Whereupon the said Reubin Gray came into Court and acknowledged his bond with Robert THOMPKINS his security in the penalty of three hundred Dollars conditioned as the law directs ---------------------- William OWENS is appointed guardian to Samuel Nancy John and Margaret OWENS infant orphans of William OWENS deceased whereupon the said OWENS came into Court and entered into and acknowledged his bond with Hezekiah SMALLWOOD and Jackson HEDGES his security in the penalty of two hundred Dollars conditioned as the law directs ------------------- Ordered that Doctor Daniel B. POTTER be requested to attend on Polly DAVIS during her illness and administer such medical aid or perform such surgical operations as may be necessary for her recovery for which he shall be allowed compensation at the next Court of claims on producing his account. ------------------- Alexander POPE Plt on motion to recover the vs amount of __ claim William WITHERS sheriff of levied at October Term 181_ Hardin County Deft for services rendered as commonwealths atty This day came the Plaintiff by Greenberry A. GAITHER Esquire his attorney and the notice herein being returned executed on the Defendant and he not appearing although solemnly called therefore on motion of the Plaintiff It is ordered by the Court that the Plaintiff recover against the Defendant the sum of one hundred and fifty Dollars it being the amount of his claim levied at October Term 1811 and due & payable at October 1812 which he the Deft failed to pay. Also his costs by him about his motion in this behalf expended and the said Defendant in Mercy ------------------ Samuel PERCEFUL appellant vs on appeal from magistrates John ROUS appellee Judgment This day came the parties by their attorneys a& after being argued and duly considered by the Court it is the opinion of the Court that the magistrates Judgment be confirmed and it is ordered that the appellee recover against the appellant the sum of three Dollars sixty two and a half cents his costs expended before the mag- istrates, also his costs by him about his defence herein expended, But the Judgment is not to operate as a bar to the recovery of the Debt due the appellant on his making a legal demand thereof ------------------------ Richard CREAL claims one days attendance for Plaintiff ------------------- Ordered that John REED be and he is hereby appointed surveyor of that part of the road which Hensly READ was formerly surveyor of and that the hands that _____ in the bounds which formerly worked on said road do now assist the said John REED in keeping the said road in repairs. -------------------- Ordered that all the hands in the following bounds (towit) Beginning at Thomas SUMMERS including him from thence to Michael MELTONs including him from thence to Nathaniel MILLERs including him from there to Peter WOOLFE including him and from thence to the Beginning do assist George NEWMAN in keeping the road in repair of which he is surveyor -------------------------- Ordered that Alexander MERRIFIELD be and he is hereby appointed surveyor of the road leading from Joseph KIRK- PATRICKs mill to his house and that all the hands within one mile from said road do assist said MERRIFIELD in opening and keeping said road in repair. ------------------------ Commonwealth Plt on motion to shew cause why against he should not be Benjamin TAYLOR Deft fined & treble taxed Ordered that the Defendant be fined the sum of five Dollars for failing to give in his list of taxable property for the year 1812 collectable in 1813 and treble taxed and that he pay the costs of this prosecution and may be taken ------------------------ Ordered that all the hands in the following bounds (towit) Beginning on the Duch fork above Captain WALTERS leaving him out including all the hands on the West fork of Nolin thence across to Middle Creek to include Robert DUN Senr including him and all the hands of his plantation from thence to the foot of the big hill from thence to John PERCEFUL including him and then to the Beginning do assist Samuel LARUE in keeping the road in repair of which he is surveyor ----------------------- Ordered that Robert ENGLISH be and he is hereby appointed surveyor of the road from Elizabeth Town to Denton GEOGHEGANs mill in Billys Creek and that John SHACKLEFORD and all the hands on his plantation Jerry SHACKLEFORD Isaac VANMETER Hezekiah SMALLWOOD Noah SMITH Cornelius RINGAS and all the hands belonging to the said ENGLISH do assist him in keeping said road in repair -------------------- Commonwealth Plt on summons against James FRENCH Deft Ordered that this case be continued unttill next Court ------------------------ Ordered that Court be adjourned till Court in Course N.
