COURT ORDER BOOK C PP 10-16 May 11th, 1812 At a County Court began and held for Hardin County on Monday the 11th day of May 1812 at the Court house in Elizabeth Town. Present Nicholas MILLER, Adin COOMBS and Lewis WELLS Esquires ---------- The resignation of Horatio WAIDE as coroner of Hardin County was produced in Court and ordered to record which resignation follows in these words To the Honorable the Justices of the Hardin County Court you will please to accept my resignation as coronor of Hardin County. Yours with respect H. WAIDE -------- John HAYWOOD came into Court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand dollars conditioned as the law directs with Charles HELM and Daniel WAIDE his Securities and took the several oaths prescribed by law ----------- Ralph STOVEAL came into Court and entered into and acknowledged his bond as constable of Hardin County with Henry DITTO and Hezekiah STOVEAL his Securities in the penalty of one thousand dollars conditioned as the law directs and took the several oaths prescribed by law. ------------ George HOWARD came into Court and entered into and acknowledged his bond as constable of Hardin County with Nicholas MILLER and Thomas SWAN his Securities in the penalty of one thousand dollars conditioned as the law directs and took the Several oaths prescribed by law --------- John GLENN came into court and entered into and acknowledged his bond as Constable of Hardin County with Jonah HALL and Robert AUSTON his Securities in the penalty of one thousand dollars conditioned as the law directs and took the Several oaths prescribed by law ---------- Samuel WELLS came into Court and entered into and acknowledged his bond as constable of Hardin County with Samuel PERCEFELD and John MILLER his Securities in the penalty of one thousand dollars conditioned as the law directs he having taken the Several oaths prescribed by law --------- Dudley ROUNDTREE and Samuel FINLEY two of the processioners of Hardin County produced in Court their Certificate of their processioning two thousand five hundred acres in the name of Robert VAUGHAN which is ordered to record. ------------ Jeremiah PATE came into Court and entered into and acknowledged his bond as constable of Hardin County with John MILLER and John ECCLES his Securities in the penalty of one thousand dollars conditioned as the law directs and took the Several oaths prescribed by law. ------------- On motion of John McDOWEL a licence is granted him to keep a tavern at his house in this county for one year from this date whereupon he entered into and acknowledged his bond in the penalty of five hundred dollars conditioned as the law directs with John ECCLES his Security -------------- On the motion of John McDOWEL and it appearing to the satisfaction of the Court that he is charged with a Stud horse at Six dollars by the commissioners instead of one town lott at sixty dollars, whereupon it is ordered by the Court that the said McDOWEL be exempted from the payment of the six dollars and stand charged for the town lott at Sixty dollars and that the Sheriff have credit for the same in his settlement with the auditor of public accounts ------------- Ordered that John MILLER be and he is hereby appointed commissioner of the revenue tax in this County for the present year in the bounds of Captain Edward RAWLINGS company in place of Robert MILLER ------------- Absent Nicholas MILLER Esquire ----------- Present Christopher MILLER William HOFSINGER Samuel MARTIN and Richard WALKER Esquires --------------- Joseph CHALFAN came into court and entered into and acknowledged his bond as constable of Hardin County in the penalty of one thousand dollars conditioned as the law directs with George HELM & Charles HELM his Securities he having taken the oaths prescribed by law. ------------ Ordered that Zachariah BUNCH be and he is hereby appointed Surveyor of the public road from the Sinks of Sandy to John COPLANDS and that all the hands on Sandy from the sinks to said COPLANDS so as to include the NEWTONs & IRELAND do assist said BUNCH in keeping the Same in repair. ------------- Jas PERCEFELD appellant vs an appeal from the ___ of Charles HELM of ____ MILLER Esq This day appeared the appellant by Greenbury H. GAITHER esq as the appelee by John MILEER esq his attorney on motion of the appelee it is considered by the Court that the appeal be dismissed and the Magistrates Judgment be and the same is hereby affirmed for the sum of 16.3 and the costs before the Magistrates and that the appelee recover against the appellant his costs by him expended in the appeal. --------- Present George HELM esq ---------- Hugh Wallace WORMLY applt vs Josiah BOON apple On appeal from the Judgment of James YOUNG one of the Commonwealth Justices of the peace. This day came the appellant by his attorney as well as the appellee by his attorney, on motion of appelee it is considered by the Court that the appeal be and it is hereby dismissed and that the Magistrates Judgement be confirmed and that he recover against the appellant his costs by him in this behalf expended ------------------- Court vs Sally WISHHART continued -------------- The last will and testament of Christopher DOUGHERTY deceased was produced in Court and proven by the oaths of John DOUGHERTY Jesse DOUGHERTY and John WATS Subscribing witnesses thereto which was ordered to record. Whereupon came Martha DOUGHERTY came into Court and made oath as the law requires the execution of the said wife is granted her whereupon she entered into bond with John DOUGHERTY & Jesse MORRISON her Securities in the penalty of eight hundred dollars conditioned as the law directs. --------------- Ordered that James BLAND James MORRISON James HAYCRAFT and Christopher MILLER be and they are hereby appointed or any three of them first being sworn before a Magistrate of this county to appraise the personal estate & slaves if any of Christopher DOUGHERTY decd and return the same to Court --------------- Jonathan, Joseph and William CARTER who were appointed to view an alteration proposed to be made in the road leading from Nolin to Bairds town this day made their report in these words Agreeable to an order of the County Court we Jonathan Joseph and William CARTER was appointed commissioners to review a part of a road leading from the Roling fork to Nolin we are of the opinion after reviewing said road that part of it moved by Thomas PRICE that it was near or nearer and rather the best way the within given under our hands this the 11th day of May 1812. Sworn to before me this Jonathan Joseph 11th day of May 1812 N. MILLER William CARTER --------------- Present Augustan GREEN & Nicholas MILLER Esq. ---------- A majority of all the Magistrates of this County being present & concurring. It is considered by the Court that Samuel STEVINSON & John MILLER be and they are hereby recommended to his Excellency the Governor of Kentucky as fit persons to fill the office of Coroner for this County in place of Horatio WAIDE esq resigned ------------- Ordered that Isom ENLOWS esq do pay to Benjamin OGDEN fifteen dollars out of the deposition which appears in his hands by Settlement made & recorded for erecting the public stocks & whipping post in this County -------------- Ordered that Benjamin OGDON have leave to remove or dispose of in any manner he may deem proper all improvements and buildings that he has made on the Jail lott out side of the walls he having done it at his own expence and received no compensation from this Court therefore ---------------- Ordered that Polley PAGET daughter of John PAGGET Deceased be and she is hereby bound unto Archibald ALLEN whereupon an indenture on the part of the Said Archibald Polley PAGET by Ben HELM Clerk of this Court and by the said Archbald ALLEN was acknowledged in Court and ordered to be recorded -------------- Alexander POPE attorney for the Circuit Court against William WITHERS Sheriff of this County on motion to recover one hundred and fifty dollars his said POPEs allowance as an attorney due October 1811. This day came the parties and on motion of the Plaintiff it is considered by the Court that the Plaintiff recover against the Defendant the sum of one hundred and fifty dollars the amount of the said allowance, also his costs by him in this behalf expended. This Judgment is to have credit by Seventy five dollars paid by Robert BLEAKLEY deputy Sheriff for the said William WITHERS. ------------ Charles HELM appellant vs on an appeal from Magistrates _____ John PERCEFULL Appelee On motion of the Deft this cause is continued till the next term of this Court.
