Ky Court Order Book C Written: August 9, 1812 Bk C, pp 28 - 34 9th August 1812 At a County Court began and held for Hardin County on Monday the 9th day of August 1812 at the Court house in Elizabeth Town. ------------- Present Nicholas MILLER Samuel MARTIN Lewis WELLS and Christopher MILLER Esquires -------------- Ordered that Luke COLVIN be and he is hereby appointed surveyor of that part of the road lying between the first large poplar about half way up SMITHs hill and HYNES lick on the road leading to MIDDLETONs ferry and that all the hands in the following bounds towit Beginning at the mouth of Mill Creek running up Mill Creek to the mouth of DORRETS run and up said run to include the EMRYS from thence to Joseph SMITHs including him then to include John HAWKINS Henry HAWKINS Gory JONES and John SHELTON do assist said COLVIN in keeping the road in repair ----------------- An additional Inventory of the estate of Thos McINTIRE decd No 3 was returned to Court by Ben HELM admin examined by the court & ordered to record ----------------- Ordered that Isom ENLOWS be and he his hereby appointed Surveyor of that part of the road which lies between Robert MARTINs & the forks of the road which leaves said road and passes William BUZANs _____blotted______ that part which he is now surveyor and that the hands which he now has under him shall assist him the said Isom ENLOWS keeping the said road in repair. ------------------ The persons appointed to view the way proposed to open a road to the Ohio river opposite the Tobacco landing this day made the following report, towit , In obedience to an order of the Worshipfull Court of Hardin County hereto annexed we have met this 28th day of July 1812 and after being first sworn according to law have viewed away for a road as named in the afforesaid order and do think It ought to run as follows to begin at Ohio river at a Cabbin nearly opposite the Tobacco landing through Jesse MOREMANs land up a quit on the lower side of the foot of the hill at the wolf pen first up said hill which may be made passable for waggonz thence along the old valley trace into the edge of the barrenz on lands the owner not known thence on through poor barrens to the buck grove as we have marked the same to the lands of John RUSH and Richard WILLET at their line in said grove and along their line till it Intersects with Brandenburgh road opposite John RUSHs house which said Brandenbu rgh road leads to Elizabeth Town and we think in all probability the foregoing road when opened will be of public utility given under our hands the day & year before mentioned. HOUSE Bethery WANNACH Ordered that Betheny WANNOCH do take the said James HYAT in to her care and keep him until the next October term of the Court to which time this cause is continued. ---------------- Commonwealth vs Samuel HAYCRAFT & others discontinued and released from HC order appointing them reviewers of the road leading from Elizabeth Town to COOMBES Mill ------------------ An Indenture of apprenticeship on behalf of Levi WANNOCK a poor child and Thomas WILLIAMS was acknowledged by the parties and ordered to record. ------------------ It appearing to the satisfaction of the Court that Sarah KIMBERLAND is charged with Tavern licence for the year 1811 collectable in 1812 which she had not, It is ordered by the Court that the said Sarah be discharged from the payment of ten Dollars for the aforesaid licence and that the sheriff have credit for the same in his settlement with the auditors of public accounts ---------------- Ordered that the new road leading to Adin COOMBS mill be resinded and the old one established and that Samuel COOMBS be appointed overseer of said road and that all the hands that assisted Walter BRISCO late surveyor of the new road in keeping the old road in repair and it is ordered that the said surveyor do work from the sign part by the meeting house to the fording place on Nolin near Adin COOMBS mill Ordered that the above order be and it is hereby recinded. ----------------- Ordered that summons issue against Aaron RAWLINGS Stephen RAWLINGS Senr ______ blotted _____ General BRADDOCK, Jacob VANMETER Junr William WADLEY Lewd PORTWOOD Benjamin TAYLOR James STEVENSON Dennis KELLEY and David JOHNSTON to appear on the 1st day of the next October Term to shew cause if any they have why they should not be fined & treble taxed for failing to give in their taxable property to the commissioners of their company --------------------------- Ordered that Nicholas MILLER & George HELM be and they are hereby appointed to settle with William WITHERS Sheriff of this county for his collection in the present year and make their report to Court. -------------------- Ordered that Christopher MILLER Samuel MARTIN George HELM & Greenberry A. GAITHER be and they are hereby appointed to examine slate and settle the accounts of Dinton GEOGHEGAN with the estate of Elizabeth Geoghagan whom he is guardian of and report to Court the Settlement so made. ---------------------- Ordered that Samuel LARUE be appointed surveyor of that part of the road leading from HODGONs mill to the rolling fork which lies between middle Creek and the foot of the hill by the sulpher spring and that all the hands that assisted Frederick TULL do assist said LARUE in keeping said road in repair. ---------------- Ordered that Moses THOMAS take into his care and keep Rebecca KYKENDALL an Infant under the age of twenty one years untill the next October Term of this Court. --------------- Ordered that Robert MARTIN Daniel KENNEDY John KENNEDY and Tobias HENDRICKS do view both the roads leading to Adin COOMBS mill that they report the conveniences and inconveniences of both roads and report which in their opinion is the best way they being first sworn before a magistrate of this County. ------------------ Ordered that the Jailer of Hardin County do bring into Court Samuel CASE who in confined therein for felony in order to give evidence in an appeal wherein William BROWNFIELD is appellant and Abraham LAMBER appellee ------------------- The persons appointed to establish the Beginning and special calls of an entry made in the name of Sarah MORGAN this day returned into Court their report which is ordered to be recorded. -------------- Ordered that Robert HUNTER be and he is hereby appointed Surveyor of that part of the road which lies between Elizabeth Town and Josiah ANDERSONs in place of William EDLIN and that all the hands that assisted said EDLIN do assist said HUNTER in keeping said road in repair. ----------------- William VITTITOW came into Court and entered into bond as Constable of Hardin County in the penalty of one thousand dollars conditioned as the law directs with John CANADY and Samuel STEVENSON his securities and took the several oaths required by law. ------------------ Ordered that _____blotted_____ issue to cause Cornelius HART Daniel LINDER Ezeriah SANDERS Charles SAWYERS Senr Charles SAWYERS Junr Robert SANDS John ASHCROFT & John CALDWELL to appear here on the first day of the next Term of the Court to shew cause why they should not be fined and treble taxed for not giving in their taxable property to the commissioners of their company --------------------- Ordered that Court be adjourned till Court in Course Lewis WELLS =================================== Transcribed by Patricia O'Connor p-oconnor@att.net Submitted by: Patricia O'Connor p-oconnor@att.net This file has been created by a form at http://www.genrecords.org/kyfiles/
