KY Court Orders July 14, 1812 Hardin County KyArchives Court Source: Hardin Co., Court Order Book C Written: July 14, 1812 Tuesday July 14th, 1812 PP 24 - 28 Tuesday July 14, 1812 Court met according to adjournment Present Lewis WELLS George HELM and Joseph STITH Esquires -------- Ordered that James HOURCHENS be and he is hereby appointed Surveyor of that part of the road leading from Elizabeth Town to HOUCHENS ferry on Green river which lies between the Crossing of dog Creek and said Ferry and that all the hands that assisted Moses CLARK do assist said HOUCHENS in keeping said road in repair ---------------------- Ordered that Robert REAMES be and he is hereby appointed surveyor of that part of the public road leading to HOUCHENS ferry which lies between Bacon Creek and the crossing of dog Creek and that all the hands that assisted George McCLAIN do assist said REAMES in keeping said road in repair. ------------------- Ordered that Aaron HART James CARSON John CANNON Jun John CARSON senr Lewis GREENAWALT John GREENAWALT Samuel CARTER John TILL Jacob CARTER do assist John BUCKLES in keeping the road in repair of which he is surveyor. ---------------- Lewis WELLS ear mark is as follows towit a crop in the right ear and underbit in the left which is ordered to record. --------------- Ordered that Lodawick GREENAWALT be and he is hereby exempted from the future payment of County Levys --------------- Present Nicholas MILLER Samuel MARTIN and Adin COOMBES Esqs -------------- An Inventory of the sales of the estate of John JACKSON deceased was produced in Court received and ordered to record. -------------- Ordered that Walter BRISCOE Surveyor of the road leading to Adin COOMBS mill do work on said road to the low water mark in Nolin and that all the hands that assists him in working on said road do work to the same place. ------------------ Commonwealth vs On Information for Bastardy Isaac MORRISON This day came the Defendant and moved the Court to bind out the child of which he is charged with being the Father which motion was overruled by the Court The Defendant filed the following bill of exceptions which was signed sealed and enrolled as a part of the record (to wit) Commonwealth vs Isaac MORRISON on Information The Defendant Isaac MORRISON by his attornies moved the Court to bind out the child of Rachel WATSON mentioned in said information to Jesse MORRISON to learn the art or mistery of shoe making said WATSON then being personally present in court as a witness and as a witness only she said WATSON not being summoned to shew cause why the child should not be taken from her and said motion being overruled by the Court Deft excepts ____and prays __. Geo HELM [seal] Lewis WELLS [seal] Adin COOMBS [seal] N MILLER [seal Joseph STITH [seal] WB the above motion was made before any proof being exhibited before the Court that said MORRISON was the father of the said ch ild ---------------------- William BROWNFIELD Plt vs on an appeal Abraham LAMBERT Deft On motion of the Plt by his attorney it is ordered that this cause be continued & that the Deft recover against the Plt his costs occationed thereby ----------------- Same vs same Hugh LAMBERT claims two days attendance for Defendant & traveling & returning thirty five miles ------------------------ Commonwealth vs Isaac MORRISON on Information of Bastardy The Defendant moved the Court to bind the child to Defendant which the Court overruled Deft filed the following bills of exceptions towit Deft moved the Court to bind the child of Rachel WATSON mentioned in said Information to the reputed father (towit) Isaac MORRISON which motion was overruled by the Court and the Deft excepts __ Jno ECCLES [seal] Jesse MORRISON [seal] Richard RUDD [seal] __ the above was presented to the Court and they refused to sign it upon which the above bystanders signed it and prays it may be signed viz The Defendant also filed the following Bill of Exceptions which was signed sealed and enrolled towit The Defendant made a motion to said Court to swear the reputed Father Isaac MORRISON in the above case but the Court did not sustain the Motion to which opinion the Deft Excepts viz and prays Viz Adin COOMBES [seal] Joseph STITH [seal] Samuel MARTIN [seal] Christopher MILLER [seal] Geo HELM [seal] N. MILLER [seal] The Defendant filed a plea of not guilty to which the Defendant Plaintiff filed a Demurre to which the Defendant _____. The Plaintiffs Demurre to the Defendants plea being argued by the counsel on both sides. It is the opinion of the Court that matters and things contained in the Defendants plea are not good and sufficient in law and that the Demurre be sustained. The Defendant also filed the following bill of Exceptions which was signed sealed and enrolled as a part of the record towit. The Commonwealths attorney produced Rachel WATSON to prove that Isaac MORRISON was the father of her child the Deft by his counsel moved the Court to compel said Rachel to produce the child with which said MORRISON was charged with being the father which the Court refused to do and the trial progressed without the presence of the child to which opinion of the Court the Deft by his counsels excepted and prays this his bill of exceptions to be signed sealed and enrolled Adin COOMBES [seal] Ch ris MILLER [seal] Saml MARTIN [seal] Joseph STITH [seal] The said Rachel WATSON being sworn and the said Isaac MORRISON being heard as well as the attorney for the Commonwealth It is the opinion of the Court that the said Isaac MORRISON is the father of the said Bastard child and that he be charged with the payment of fifty five dollars for the support and maintenance of said child to be paid in the following manner towit fifteen dollars on the 14th day of July 1813 fifteen dollars on the 14th day of July 1814 ten dollars on the 14th day of July 1815 ten dollars on the 14th day of July 1816 and five dollars on the 14th day of December 1816 whereupon the said Isaac MORRISON came into Court and entered into and acknowledged his bond in the penalty of one hundred and ten dollars with Jesse MORRISON his security conditioned agreeable to the above order. ----------------- Ordered that John SNEED be and he is hereby appointed surveyor of the part of the road leading from Elizabeth Town to the head of Rough Creek that lies between the East fork of Rudes Creek and where it intersects the Breckenridge road and that all the hands that assisted Elias DRURY do assist said SNEED in keeping the road in repair. ------------------------------ Ordered that Court be adjourned till Court in Course C.
