KY Court Orders November 9, 1812 Hardin County KyArchives Court Source: Hardin County Court Book C Written: November 9, 1812 Hardin County Court Book C pp 42 - 46 November 9th 1812 At a Court began and held for Hardin County on Monday the 9th day of November 1812 Present Lewis WELLS George HELM and William KEPLINGER ---------------- On motion of William WOOLFOLK & he making Satisfactory proof to the Court that he does now own the following negroes Slaves towit MARY a girl aged sixteen years with a light complexion and small of her age. PATRICK a boy aged thirteen years well grown with a dark complexion, WILSON a boy aged ten years with a dark complexion and tolerably spare which he got by marriage with his wife Susan C. WOOLFOLK late Susan C. WOOLFOLK and that he the said William WOOLFOLK wishes to remove the said slaves to the State of Virginia, It is therefore ordered by the Court that the Same be entered of record and certified accordingly. --------------- Ordered that Suddeth MEEKS be and he is hereby appointed surveyor of that part of the road which lies between John COPLAND and Cain run and that all the hands that did assist said COPLAND do assist said MEEKS in keeping said road in repair. -------------- Benjamin HELM Clerk of the County & Circuit Courts for this County produced in Court his amount of taxes recd on law processes Deeds County Seals &c which was sworn to and certified to the auditor of public accounts. --------------- Samuel WELLS William KEPLINGER and Lewis WELLS Esquires produced in Court a return of fines received by them Since the last Court of Claims which was examined and received by the Court. ------------- Ordered that George HELM and Adin COOMBES be and they are hereby appointed commissioners to Settle with William WITHERS sheriff of Hardin County for the present year and that they return the Settlement so made to Court. --------------- Ordered that Benjamin HELM be authorized to purchase a lott of Littalls Laws of Kentucky for the use of the Court and that he render an account thereof to next court. --------------- Samuel STEVENSON Esqr produced in Court a commission from under the hand & seal of his Excellency Charles SCOTT Esquire Governor of Kentucky appointing him a coroner. Whereupon he took the several oaths required by law and entered into and acknowledged his bond with Charles HELM & Walter MUDD his Securities in the penalty of one thousand pounds conditioned as the law directs. -------------- On motion of Elizabeth CLOSE the administrator of the estate of George CLOSE deceased is granted her whereupon she entered into and acknowledged her bond in the penalty of one hundred and twenty dollars conditioned as the law directs with George HIGHBOUGH her security she having taken the oath the law directs. ------------- Ordered that Dudly ROUNDTREE Isaac FINLEY Samuel HENLEY and John WRIGHT be and they are hereby appointed commissioners or any three of them to appraise the personal estate and slaves if any of George CLOSE deceased they being first sworn before a magistrate of this County and that they make return to Court. ------------- Ordered that Samuel PICKERAL be appointed Surveyor of the road that James COE was formerly surveyor and that the hands that assisted James COE do assist said PICKERAL in keeping said road in repair. -------------- On motion of Philip ROWLETT It is ordered that Isaac FINLEY Dudly ROUNDTREE and Isaac WOOD or any two of them be and they are hereby appointed commissioners to establish the beginning and special calls of three entries in the name of George WALTON containing 1818 acres one in the name of William HENRY containing 300 acres one in the name of WILLIAM FERRELL containing 400 acres and that the Clerk on application of the said ROWLETT issue a warrant for that purpose. ---------------- Ordered that William JOURDAN & John BREWER be and they are hereby appointed patrollers in the place of John SHEROD & William LARKIN who refuses to serve in the District on the Rolling fork & Clear Creek. ----------------- Ordered that Nimrod HOUSE Simmons HARWILL Henry NEASE Robert HAZELIP Solomon KASINGER Sen John SMOOT Senr James WEST Sen Samuel WATKINS Sen and William WILLIAMS be and they are hereby exempted from working on public roads for the future. ------------- Charles HOUCHENS Senr is hereby exempted from the future payment of County levy and from working on public roads. --------------- Ordered that Alias Summons be issued against all the persons returned for not giving in their list of taxable property to shew cause why the should not be fined and treble taxed for not complying with the requisitions of the law in that case made and provided. ------------ Ordered that William WITHERS sheriff of Hardin County be summoned to appear before this Court on the 1st day of the next Term thereof to shew cause why he should not be fined for a contempt offered the Court in failing to execute precept issued against several persons for not giving in a list of their taxable property. --------------------- Ordered that Court be adjourned till 8 Oclock tomorrow morning Lewis WELLS =================================================== Tuesday November 10th 1812 the Court met according to adjournment Present George HELM Lewis WELLS and William KIPLINGER Esquires ------------------- BERRY a negro man this day produced in Court the following Instrument of writing emancipating the said BERRY from Slavery which was ordered to record and follows in these words (towit) Know all men by these presents that I Paul MICHUM of Hardin County and State of Kentucky do by these presents emancipate set free and forever discharge from Service from myself my heirs and all and every other person or persons whatsoever a certain negro man Slave (now my property and bred and raised by me) named BERRY and do acquit said BERRY from all claims ordains to his Service as a slave from me my heirs executors administrators or assigns forever and declare him the said BERRY to be a free man In witness whereof I have hereunto set my hand and seal this day of November 1812 Attest Paul [X] MECHUM [seal] John SMOOT Wm VINESETT Whereupon the said Paul MECHUM together with John SMOOT and William VINESETT entered into and acknowledged his bond in the penalty of five hundred dollars conditioned to keep the said BERRY from becoming a County charge. ------------------- Commonwealth vs an summons to shew cause why Barbara VANCE her children should not be bound out Ordered that this motion be laid over until the next Term of this Court. -------------------- Present Adin COOMBS and Christopher MILLER Esquires -------------------- Ordered that George HELM be and he is hereby appointed curator to the estate of Jacob KYKENDALL and that all the estate of the said KYKENDALL be put into the hands of the Said curator to be dealt with by him according to law. ------------------ Ordered that Court be adjourned till Court in Course Lewis WELLS =========================================== Transcribed by Patricia O'Connor p-oconnor@att.net Submitted by: Patricia O'Connor p-oconnor@att.net This file has been created by a form at http://www.genrecords.org/kyfiles/
