Fortieth Infantry (Mounted). -- Col., Clinton J. True; Lieut.- Col. Mathew Mullins, Majs., Thomas H. Mannen, Frederick H. 
Bierbower.

Under the authority of a special act of Congress, Col. True, who had been an 
officer in the 20th Ky. infantry, recruited this regiment. The men were from 
the eastern part of the 
state and the regiment was mustered into the service at Grayson, Carter 
county, in Sept., 1863, to serve for twelve months.

Cooperating with Col. Gallup it met and routed Ferguson near Paintsville in 
April, 1864. Morgan reached Mt. Sterling in June, near which place he overcame 
the forces then under Gen. Hobson, but a few days later the regiments under 
Cols. Hanson, Gallup, Brown, and True, which had followed hard on Morgan's 
track, fought him at Cynthiana, routed him completely, and pursued him through 
the mountains out of the state.

In this the regiment bore its part most handsomely as the official reports 
show. In September the regiment went with tie expedition under Gen. Burbridge 
to Saltville, Va. After the return from this expedition it remained on duty in 
eastern Kentucky until Dec. 30, 1864, when it was mustered out.

Lemuel Johnson s/o William Johnson was born in 1833 and served one year in the 
40th Ky Infantry. He died 26 Sep 1864 in Marion Co., Lebanon, KY
