Murphy, to be in the hand writing of James Allen, Dec’d and on the evidence of James Allen, Jr. the same was proven to be the last will and testament of said James Allen, Dec’d signed and so delivered in the presents of me. The said James Allen, Jr. and James G. Bulldock who were subscribing witnesses to said writing whereupon the same is ordered to record and Benjamin N. C. Allen who is nominated and appointed executor to said will approved in court had the oath of office administered to him and with R. P. Murphy surely entered into bond to the commonwealth according to law. Attested T. W. Wash, clerk cc I, James Allen of Casey County and State of Kentucky, considering the uncertainty of this mortal life and being in perfect mind and memory, blessed be Almighty God for the same do make this my last will and testament in manner and form as followest: first, I recommend my body to be buried in a Christian like manner and all my just debts be punctually paid agreeable to my contract whether in legal interest or usury. I hereby give and bequeath to my wife, Frances Allen my farm on which I live with all my lands adjoining thereto except what is otherwise devised. Also my slaves to wit, William, Thomas, Amanda and Martha, her choice, two horses, two cows and calves, two breeding sows, one yoke of steers, household and kitchen furniture and cart or wagon with one years provisions for the family, to be allotted to her by the judgment and discretion of my executor. Also a buggy and ten head of sheep and farming utensils to have and enjoy during her natural life. I have given to my daughter Sally A. Meredith in her life one hundred and seventy five dollars. I have given to my son, B. Newton C. Allen one Negro boy named George Alfred which he has raised and now has in his possession which I value at two hundred dollars and fifty acres of _____ land at twelve dollars and fifty cents, also one hundred dollars he said he is to account for. I have also given to my son Zaddock M. Allen one tract of land which Samuel Cabble now lives on which I value at four hundred dollars. I have given to my son James G. Allen one horse and money I valued at ninety dollars. I also have given to my daughter, Julia Anne Land, a negro girl named Orpha Jane which I valued at five hundred dollars. I also have given to my son Sovern W. Allen one yoke of oxen and money valued at ninety dollars. I also have given to my daughter Catherine M. Cabble one tract of land called Richards Isle and which she by her husband has now in possession. I valued at fifty dollars. I also gave to her part of a field on the north side of Green River beginning at a beach at the NW end of where the drawbars now stands then S 18, W 30 poles, N 18, W 30 poles to a stone in said field thence a straight line that will strike the middle of a wall found in said field and to continue said course till it strikes Green River thence down the same until it comes opposite the division fence between Samuel Cabble and myself thence with the division fence until it strikes the upper fence of same field thence with the fence as it now stands to the beginning which at my death is to have possession. I valued at one hundred dollars _____ _____ _____ _____ _____. To my son, B. N. C. Allen I have also delivered to him what contains the meets and boundaries _____ of the same. At my death my executor to make sale of all my estate not herein divided at a credit that will best suit the circumstances of the estate agreeable to the best of his judgment. I have stated in the foregoing _____ _____ each one has not received more than my other children. It is my will that my estate shall be equally divided between my children. In the final charging each one the same by me stated as given or devised and any sums hereafter by me or my executor paid over to any of them it is to be fairly understood that the sums received devised, agreeable to my volition hereafter paid by my executor to be accounted out of the shares of these who have received otherwise. It is my will that my daughter, Sally W. Meredith have one tenth part of my estate. B. N. C. Allen one tenth part. Z. M. Allen one tenth part. Betsy Ann Crutchfied to have one tenth part of my estate. My daughter Peggy Jane Allen to have one tenth part. My daughter Catherine M. Cabble to have one tenth part. My son James G. Allen to have one tenth part. My daughter Emily J. Mullins to have one tenth part. My daughter Julia Anne Land to have one tenth part. My son Sovern W. Allen to have one tenth part of my estate. And at my wife, Francis Allen’s death my executor to make sale of the balance of personal estate and lands devised to my wife by giving notice publicly, without decree by court for the sale as hereby ordains and appoints to my son B. N. C. Allen my sole executor to this my just will and testament.
