McGinnis April 21, 1864 Warren County KyArchives Deed Written: April 21, 1864 Recorded: July 25, 1864 Warren County, Kentucky Deed Book 30, pages 320-321 This Indenture made this 21st April 1864 between J. J. McGinnis & his wife Elizabeth McGinnis party of the first part and S. J. Brooks party of the Second part all of Warren County Kentucky. Witnesseth that whereas at the February term of the Warren Equity & Criminal Court 1864 in the Suit of H. J. McGinnis against Walter Brooks and his wife S. J. Brooks it was decreed that the plaintiff McGinnis party of the first part Convey by general warranty deed the tract of land mentioned in the pleadings (and hereinafter described) to the defendant party of the Second part S. J. Brooks to have and to hold during her life and at her death the title to Said land to descend and vest in her present children and Such children as she may hereafter have and whereas it was further ordered and decreed that Said McGinnis be released and discharged from his liability to the Said S. J. Brooks for and on account of the Eleven Hundred and Seventy Dollars which he received from the Executor of the will of B. McGinnis dec'd as the portion of Said estate coming to Said S. J. Brooks upon his executing the deed as aforesaid. Now in Consideration of the promises [?] the party of the first part hereby Conveys and Confirms unto Said S. J. Brooks and William Brooks, M. A. Brooks, her present Children and Such Children as she may hereafter have Said tract of land lying in Warren County on the Waters of Gasper River Conveyed to party of the first part by George J. Waddle April 1860 and bounded as follows to wit Beginning at 2 hickories one down[?] South East corner of the Original Survey thence with one of its lines N11E true course N11-3/4E 57 poles to the intersection of a line of Edward B??? 1000 acre Military Survey thence with a line of Said Survey N1W 19 poles to a planted Stone in Said line thence N30W 45 poles to 4 Small Sycamores on the South Side of a creek thence down Said creek N51E 26 poles to a honey locust Standing on the Creek on a line of the aforesaid Military tract of land, thence with Said line N1W 14 poles to a planted Stone in Said line where Moses Taylor intersects said line thence with Said Moses Taylors original line of which this is a part N77-3/4W 75 poles to a large poplar in a Small ravine Corner to James B. Taylor thence with his line S10E 20 poles to a white walnut another of Said Taylors corners thence with another of his corners S81-1/2W 127 poles to the original line of Moses Taylors Survey and Corner to Said J. B. Taylor thence with Said line S10W 40 poles to a hickory, dogwood and two Small beeches marked as pointers about 4 poles South of the creek thence with the Original line of Said Moses Taylor S80E 20 poles now 19 poles to a Stone, thence S15E 73 poles to a hickory Stump an original corner thence with the Original line S80E true Course S79-3/4 E 150 poles to the Beginning Containing 176-3/4 acres more or less. To have and to hold Said tract of land unto the Said S. J. Brooks for & during her natural life and at her death the title to Same to descend and vest in her present children William & M. A. Brooks, and Such other children as She may hereafter have And Said party of the first part agrees with the party of the Second part to warrant the title to Said land Generally. In testimony of all which H. J. McGinnis together with his wife Elizabeth McGinnis, who writes herein and hereby relinquishes to Said land have hereunto Set their hands & Seals. H. J. McGinnis & Elizabeth McGinnis his wife to S. J. Brooks was produced to me in my office on the 21st day of April 1864 and acknowledged by H. J. & Elizabeth McGinnis to be their act and deed and Said deed being Stamped as required by act of Congress & the tax being this day paid I have recorded Said deed with this Certificate in my office as required by law.
