Brooks of the County of Bullett and same State of the other part Wherefore that the said Hannah Withers, John Withers, Gidion Withers, Hiram Withers, Silas Withers, Samuel Shackelford & Ann Shackelford, John Murrell & Sarah Murrell his wife, William Montgomery & Elizabeth his wife, Robert Blackley & Dorcas his wife, Nancy Stewart, & John Merrifield & Sarah his wife for and in consideration of a certain relinquishment from the said William Withers to Silas Withers the sum of one hundred dollars to the said Silas Withers in hand paid by the said Joseph A. Brooks the receipt whereof is hereby acknowleged by him and to Convey Carry into offices the contract between the the said Silas Withers and the said Brooks Have granted bargained and sold And by these presents do grant bargain and sell a lien ____ convey and confirm unto the said Joseph A. Brooks his heirs __ forever a Certain tract or parcel of land being situate lying and being in the County of Bullitt on the Waters of Floyds fork containing three hundred and twenty five acres and bounded as follows towit Beginning at a white oak marked thus G W & W W standing on the Old Trace leading from the Fish pool to Phillips Spring running thence east Two hundred poles to a hickory & white Oak & Spanish Oak North Two hundred and sixty poles to a white oak & Spanish Oak, West two hundred poles to a white oak & two Beech trees, thence South two hundred and sixty poles to the Beginning Being the same land which was patented to the said William Withers by patent bearing date the 23rd day of February 1800 _____ being thereto had will more fully appear. To have and To hold the said Tract or parcel of land with all the appurtenances unto him the said Joseph A. Brooks his heirs all free and clear of and from all right title or Dower and to his their only proper use benefit and behalf and the said Hannah Withers, John Withers, Gidion Withers, Hiram Withers, Silas Withers, Samuel Shackelford & Ann Shackelford, John Murrell & Sarah Murrell his wife, William Montgomery & Elizabeth his wife, Robert Blackley & Dorcas his wife, Nancy Stewart, John Merrifield & Sarah his wife For themselves their heirs __ do covenant and agree to ____ with the said Joseph A. Brooks & his heirs that they will and their heirs shall warrant and forever defend the said tract or parcel of land with all the appurtenances unto him the said Joseph A. Brooks & his heirs from themselves & their heirs & all persons Claiming under them or either of them but not against the Claim or Claims of any other person or persons whatsoever. It being the intention of the parties only to Convey the right title which they as heirs as aforesaid have to possess under the Claim of the said William Withers deceased and they are not to be liable in any way of the said land should be taken away by any superior or better Claim. In Testimony Whereof the said Hannah Withers, John Withers, Gideon Withers, Hiram Withers, Silas Withers, Samuel Shackelford & Ann Shackelford, John Murrell & Sarah Murrell his wife, William Montgomery & Elizabeth his wife, Robert Blackley & Dorcas his wife, Nancy Stewart, & John Merrifield & Sarah his wife have hereunto set their hands & seals on the day and year within Written. Brooks do by these Wm Montgomery [seal] presents declare that I will Elizabeth Montgomery [seal] release the said grantor above Robt Blackley [seal] from all liability and recourse on Dorcas Blackley [seal] account of any defect of title Nancy Stewart [seal] Wm Withers or if the said land John Murrell [seal] Should be forfeit by any other claim Sarah Murrell [seal] Witness my hand on this 10th day John Merrifield [seal] Of May 1822 Joseph A. Brooks [seal] Sally Merrifield [seal] I the clerk of the Hardin County Court in the State of Kentucky do certify that on the day of the date hereof Nancy Stewart and Dorcas Blackley personally appeared before me in my office and acknowledged the foregoing Indenture or Deed of bargain and sale to Joseph A. Brooks as and for their act and deed they the said Nancy & Dorcas (the said Dorcas being examined separate and apart from her husband) also declared that they freely and voluntarily relinquished all the right title Interest Claim and demand which they have in and to the land thereby conveyed as heirs of William Withers deceased and that they were willing the same should be recorded which is certified to the clerk of the County Court of the County in which the land lies to be entered of record. Given under my hand this 11th day of May 1822 Saml Hay aft for clk State of Kentucky I the clerk of the County Clerk of Bullitt County do Certify that on the 19th day of November 1822 Hannah Withers came personally before me in ___ and acknowledged & delivered the foregoing Indenture of Bargain & sale to be her act and deed and being examined by me as the low directs relinquished her right of ____ of in & to the land within mentioned and on this 10th day of May 1822 John Withers, Hiram Withers, Silas Withers & William Montgomery & Elizabeth his wife came personally before me and acknowledged & delivered the said indenture of bargain & sale (she the said Elizabeth being examined personally & apart from the sd William) to be their act and deed as heirs of William Withers decd and on the 11th day of May 1822 Robert Blackley came personally before me and acknowledged the said Indenture to be his act and deed and on the 26th day of May 1822 Samuel Shackleford, Ann Shackleford, John Murrell, Sarah Murrell as heirs aforesaid came personally before me and acknowledged the said Indenture as and for their act & Deed and on the 27th day of May 1822 John Merrifield & Sally his wife heirs as aforesaid came personally before me and acknowledged and delivered the said Indenture of bargain & sale to be their act and deed. And on the 12th day of October 1822 Gideon Withers came personally before me and as one of the heirs aforesaid acknowledged & Delivered the said Indenture to be his act and deed, and on the 10th day of May 1822 Joseph A. Brooks came personally before me in my office and acknowledged & Delivered the Bond whither under the said Indenture to be his act & deed. Whereupon I have recorded the said Indenture of Bargain & sale with the Certificate therein endorsed __ __ sale and the said Bond with this Certificate in my office as required by Law. Geo F.
