Ky Will Book A Pages 403 & 404 Written: December 25, 1833 Recorded: January 18, 1834 Will of Joseph Brown In the name of God Amen. I Joseph Brown of the County of Saint Charles and state of Missouri being weak in body but of sound and perfect mind and memory and considering the uncertainty of the mortal life and blessed be Almighty god for the same do make and publish this my last writ and testament in manner and form following. Item 1st I wish all my just debts paid by the sale of a house and lot I own in the Town of Taylorsville Spencer County Kentucky and the balance to be appropriated as hereafter named. Item 2nd I givve and bequeath unto my beloved wife Jane K Brown so long as she remains my widow a certain tract of Land purchased by me of Richard Kerr and containing four hundred and five acres be the more or less being and lying in the county of Saint Charles and on the waters of the Cuirse? River and adjoining the lands of Henry Zumwall and Jones confirmed claim also three negroes one Boy named Tom two girls one named Agness and the other named Caroline together with all my stock of Horses Cattle hogs sheep and house hold and other furniture farming utensils the above named property I wish to remain hers so long as she remains a widow and in case she shall marry again I will and bequeath unto her the above named Caroline and Agness two of the choice horses two cows two beds beadsteads and Bedding house hold furniture to have & to hold to her in heiers & forever. Item 3rd I will and bequeath to my Brother Samuel Brown provided my Wife should die or marry, the tract of Land which I purchased of Richard Kerr containing four hundred and five acres be the same more or less being and lying in the county of Saint Charles and on the waters of Cuirse River and ajoining the Lands of Henry Zumwalt and Jones confimed claim above town but in Rockport Spencer County Indiana. One negro boy named Tom my god watch chain and farming utensils. Also I will and bequeath unto Ann Simpson one hundred Dollars to be paid out in land or congress price in Missouri or Indiana which money will be appropriated by my brother Saml from of the property beforementioned after paying my just debts also I will and bequeath unto Samuel Brown one note of hand I hold against him for one hundred & fifty dollars together with the other property not willed to my Wife provided she shoud die or marry again. Item 4th I will and bequeath unto my brother James H Brown my silver watch. Item 5th and I do hereby appoint my brother Samuel Brown and my wife Jane K Brown my joint executors with the will annexed. In testimony I hereunto set my hand and seal this 25th day of September eighteen hundred and thirty three. Clerk of the County Court within and for the County aforesaid Certify that on the 25th day of December 1833 the within will of Joseph Brown Deceased was produced to me at my office in the Town of Saint Charles in the county of Saint Charles for probate and Zacheriah T. Woolfolk and James Kerr two of the Subscribing witnesses thereto appeared before me and made oath that the said Josep Brown signed sealed acknowledged and declared the same to be his last will and testament that he was of sound and desposing mind and that they signed their names thereto as witnesses in his presence and in the presence of each other as the to appears which said will is so proven is approved in common form of Law. In testimony whereof I have hereunto set my hand and affixed the seal of said court at office this 25thday of December AD 1833. signed Wm Christly Jnr. State of Missouri County of Saint Charles} I William Christly Jnr Clerk of the county court within and for the county aforesaid Certify that the above and foregoing is a true Copy of the original of which is recorded in my office according to law In testimony whereof I have here unto set my hand and affixed the seal of said Court at office this 18th day of January AD 1834 Wm Christly Jr At a County Court held for Spencer County on Monday the 1st day of September 1834 this authenticated copy of the last will and Testament of Joseph Brown Decd of the State of Missouri was produced in court by the Executors therein named and being proved to be a Copy of the last Will and Testament of said Josep Brown Decd is ordered to be recorded. And on the motion of Samuel Brown and Jane K Brown the Executors there in named who made oath thereto and together with James H Brown and Alexander W Thomas their Securities entered into and acknowledged a Bond in the penalty of 2000 conditioned as the Law directs certificate is granted them for obtaining a probat of the said Will in this note in due form.
