As said Reuben is to heir the land at the death of his mother witnesseth that the said Samuel Tinsley and Olive his wife, for and in consideration of the sum Thirty five pounds ten shillings in hand paid, the receipt whereof is hereby acknowledged Hath by these present hath bargained and sold released conveyed all their rights and title and interest in a certain tract of land being a part of Nelson Harris’s 1000 acre survey it is situate in the County of Shelby including some of waters of Jeptha’s Creek and some of the waters of Benson’s Creek and bounded as follows Viz. Beginning at a beech tree standing on the west side of said Caty Bullard’s spring branch, thence up said branch N 48 ½ E 96 poles to the south end of the lane between Reuben Bullard and William Bullard, thence N 4 E30 poles to two sugartrees standing in the north end of said land, thence east with said Harris’ line 126 poles to 3 beech trees two of which is (sic) marked E.G. standing in Nelson Harris’ N E corner on the south side of a branch of Benson Creek thence south with said ___ Harris’s line to William Sanders corner on the point of a ridge at three beech trees thence west with Sanders line 178 poles to the Beginning containing by estimation 71 acres together with all and singular its appurtenances. To Have and to Hold the said tract or parcel of land with its appurtenances unto the said Caty Bullard and Reuben Bullard and their heirs and the said Samuel Tinsley doth covenant and agree to and with the said Caty and Reuben Bullard their heirs and assigns that He the said Samuel Tinsley will warrant and forever defend the said land with its appurtenances unto them the said Caty and Reuben Bullard and their heirs etc. and against all and every person or persons claiming or to claim the same under by or through the said Samuel Tinsley his heirs or assigns but not against any other person otherwise claiming the same And it is also to be understood that if the said land should be lost or recorded from the (end p 149 begin p 150) said Caty Bullard and Reuben Bullard otherwise than under or through the said Samuel Tinsley that the said Tinsley shall not be bound , or in any wise affected thereby In whereof I have hereunto set my hand and seal the date above mentioned. This Indenture was this day produced into Court and acknowledged by the within named Samuel Tinsley and Olive his wife to be their act and deed.
