I John CARLAND of Spencer County and state of Kentucky being weak in body but sound in mind and memory and considering the uncertainty of life do make this my last will and Testament in manor and form following towit. Item. I want all my just Debts paid the first thing. Item I will and bequeath to my brother Peter CARLAND all my rights title claim and interest to or in two tracts or parcels of land that my brother Peter and myself bought in partnership also all my right and title to a four acre Lot of Ground that was left to me by the Will of my father Matthias CARLAND Dec'd all of said Land lying and being in the County and state aforesaid. I also give and bequeath to my Said Brother all my right title claim and interest to all the stock of horses cattle and hogs also all my interest in all the money on hand, notes or Book accounts, also all my interest in a negro man named JACK and a negro girl named MARTHA, also all my interest in the Distillery, horse mill and every other species of property that I have an Interest in that is not above mentioned. Item. My will and desire further is that my said brother Peter shall pay my mother Eleanor CARLAND two hundred dollars out of my estate in six months after my decease. Item. My will and desire further is that my brother Peter shall to the son of my brother Joseph, namely John William CARLAND one hundred and fifty dollars in six months after my decease. Item My will and desire further is that my brother Peter shall pay to my brother William two hundred dollars in twelve months after my decease. Item My will further is that my brother Peter shall pay to my brother David F. two hundred dollars in twelve months after my decease. Item My will further is that my brother Peter shall pay to each of my sisters namely Emily, Polly and Sally two hundred each in two years after my decease. Item My will further is that if my brother Peter shall die without heirs then and in that cast the residue of my Estate that he may then have is to be equally divided between my brothers William and David and my three sisters Emily, Polly and Sally. Item I herby ordain constitute and appoint as my Executor to this my last Will and testament my brother Peter CARLAND with full power and authority to carry this will into full and complete effect. In testimony whereof I have hereunto set my hand and seal February 2nd 1837. Wittness Edmund STONE John CARLAND [seal] Thomas BRYANT At a County Court held for Spencer County on Monday the 3ed day of July 1837, this writing purporting to be the last will and Testament of John CARLAND deceased was proved according to Law by the oaths of Edmund STONE and Thomas BRYANT the witnesses thereto and is ordered to be recorded. And on the motion of Peter CARLAND the Executor therein named who made oath thereto and together with George K.
