Deed Bk C, p 84, 85 Caldwell; Cocke; Askins; Walton; Brown; Robin; This Indenture made this second day of October in the year of our lord one thousand eight hundred and four between George Caldwell of the County of Mercer Asso. Of Phillip Waters attorney in fact for Mary heir at law to John Askins deceased of the one part, and Richard Cocke of the County of Washington of the other part. WITNESSETH that the said George Caldwell for and in consideration of the sum of one thousand dollars to him in hand paid by the said Richard Cocke the receipt whereof he doth hereby acknowledge hath granted Bargained sold Enforced and Confirmed and by these presents doth grant bargain sell enforce and confirm unto the said Richard Cocke his heirs and assigns forever a certain tract or parcel of land Containing six hundred and eighty four acres be the same more or less situate in County of Washington on Cartwrights Creek and its waters including the mouth of road run being all that part of John Askins preemption which is not covered by two surveys of Matthew Walton of the three thousand seven hundred and forty acres the other six hundred acres and bounded as follows to wit Beginning at the southwest Corner of the said Askins Preemption at a Large tree dogwood and Grapevine Between the said Creek and road run thence with a line of the said Preemption east two hundred and eighty six poles to a stake where the said line intersects a line of Daniel Browns three hundred acre survey at a Corner to land this day conveyed to said Matthew Walton thence with a line of the said Browns three hundred acre survey also with a line of said Browns Settlement Tract and to the said Waltons Three thousand seven hundred and forty acre survey north fifteen degrees West two hundred and eighty four poles to the said Waltons Corner at a sugartree and Ironwood thence with a north of Waltons line North eighty three east ninety two poles to a buckeye sugartree walnut and hickory on the south side of a hill corner to said Waltons six hundred acre survey thence with a line thereof north thirty eight degrees east one hundred and forty one poles to a stake in a line of the said Askins Preemption thence with the said line leaving Walton West three hundred and eighty eight poles crossing Cartwrights creek at about two hundred and eighty eight poles to a black walnut ash and hickory at a corner of the said preemption on the east side of a hill about twelve poles west from the widow Robin’s Spring Branch & about forty poles from the said Creek thence with another line of the said preemption south four hundred poles crossing Cartrights creek to the Beginning with its appurtenances to have and to hold the said tract or parcel of land with all and Singular its appurtenances to the only proper use and behalf of him the said Richard Cocke his heirs and assigns forever against himself and his heirs and against all persons claiming by thru or under him or claiming under the said John Askins Decd. But not against the claim or claims of any other person and it is farther understood and Expressly Agreed by the parties that neither the said George Caldwell nor his heirs is bound to refund the purchase money or any part thereof in case the said land or any part thereof be taken by prior or better claims hereafter except those before mentioned.
