I John CUMMINS of the County of Nelson being very sick and weak in body but of Perfect mind and memory do make and ordain this my last will and Testament (that is to say) principally and first of all I recommend my soul unto the hand of almighty God that gave it and my body I recommend to the earth from whence it came - and as touching such worldly Estate wherewith it has pleased God to bless me in this life, I give devise and dispose of the same in the following manner and form. (viz) First I give and bequeath unto my well beloved son Samuel CUMMINS one hundred acres of Land in Warren County which shall include one half of my two hundred acres to be laid of at that and of the land which joins a Military line Secondly I give & bequeath unto my well beloved son James CUMMINS one hundred acres of land in Warren County which shall include the other half of the two hundred and fourteen pounds in good trade to be paid out of my other property and one horse Saddle and bridle when he comes to the age of Eighteen years. Thirdly I give unto my well beloved wife Elizabeth CUMMINS the plan whereon I now live during her natural life with the stock thereon but to make a sale of what things are not necessary in the House or about the farm and all debts dues ordinaries that I have against any one and to pay any Just debts that may be against me and at her death the whole to be Equally divided among my other children (Samuel and James having no part in that division) so that the account I have against any of them for property already given them may be first Counted in their part of the said division and lastly I constitute my said wife, James VANCE & William NEALE the sole Executors of this my last will and testament and I do hereby utterly revoke and disannul any and every other former Testaments, wills, legacies bequests and Executors by me in any wise mentioned Willed or bequeathed Ratifying and confirming this and no other to be my last will & Testament. In witness whereof I have hereunto Set my hand and seal this Seventeenth day of January one thousand eight hundred & thirteen Signed Sealed & delivered in the presence of Robt. STEWART Thomas [X] MONTGOMERY John CUMMINS [seal] Agnes [X] MONTGOMERY At a County Court held for Nelson County on Monday the 19th day of April 1813 This last will and Testament of John CUMMINS deceased was proved by the oaths of Robert STEWART & Thomas MONTGOMERY two of the subscribing witnesses thereto & ordered to record and on the motion of Eliza CUMMINS widow of sd John, James VANCE & William NEALL the Exors therein named having taken the oath prescribed by Law and Executed bond with Thomas MONTGOMERY & Joseph FROMAN their securities in the penalty of $6000. Conditioned according to Law It is ordered that Certificate of probate of said will be granted the said Executors.
