Cha W FORREST Examining Clerk State of Kentucky Hardin County Sct On this 28th day of December 1839 before me John FIFE a Justice of the peace in and for the County of Hardin and State aforesaid personally appeared Sally CUNDIFF a resident of the County of Hardin and state aforesaid aged Eighty years Who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provisions made by the Act of Congress passed July 4th 1836. That she is the widow of John CUNDIFF Late a pensioner on the Roll of the Kentucky agency, she further declares that she was lawfully married to the said John CUNDIFF on the fifteenth day of May Seventeen hundred and Seventy Eight in the County of Bedford in the State of Virginia by the Revd Samuel NOTH, who belonged to the Church of England, That her husband the aforesaid John CUNDIFF died on the Eighteenth day of September Eighteen Hundred and thirty seven And that she has remained a widow ever since that period. She further declared she knows of no record evidence of her marriage But she has on a loose piece of paper the family record of the age of her Children which she will have exhibited in Support of this claim She knows of no one now living that was at the wedding or saw her married to prove her marriage by Sally [X] CUNDIFF State of Kentucky Hardin County Sct The above declaration was this day sworn to and subscribed by Sally CUNDIFF before me a Justice of the peace in and for the County of Hardin And I certify the said Sally CUNDIFF in consequence of old age and bodily infirmity is unable tot attend Court. Given under my hand this 28 day of December 1839 John FIFE JPHC Declaration in order to obtain the benefit of the Act of Congree passed June 7th 1832 State of Kentucky County of Hardin SS On the 19th day of September in the year of our Lord one thousand Eight hundred and thirty two, personally appeared in open Court before the Hon Paul J. BOOKER, Commonwealth Circuit Judge, now sitting, John CUNDIFF, a resident of the state of Kentucky and County of Hardin, aged 76 years on the 14th day of January ensuing the date hereof -- who being first duly sworn, according to law, doth on his oath make the following declaration in order to obtain the benefit of the Act of Congress passed June 7th 1832-- That he entered the service of the United States under the following named officers and served as herein stated. About the time that the British forces were coming around to Petersburgh, he volunteered for three months and entered the service under Captain Joshua EARLY or YEARLY -- William LEFTRIDGE Commanded as Major Charles LYNCH as Col-- The day and monthe, or even the year, he is unable to speak of, or fix with certainty -- as he was an illiterate man, and could keep no memorandum of dates or other events. He states that he served out said term of three months -- at the expiration of which he was marched back with the same officers, into Bedford County Virginia where he originally volunteered, and in which he resided. He further states that perhaps about a year after he was discharged from his first engagement he again volunteered in service for the term of three months, he still residing in the same county of Bedford and state of Virginia. At this time he was mustered in to the Service, at a place called Water lick and his Captains name was Alexander CUMMINGS, or CUMMINS -- he was marched from that place down towards James River, by a place called -- Long ONERY, ( a country inn) to what was called the pouety fork, a branch of James River. In this time they were united with some other companies -- and men under the command of a Col. TUCKER, and General LAWSON. At the "pouety fork" he and the troops with him united with Baron or General STEUBEN -- who was in command of a part of the American troops. At the junction of the Pouety fork, the troops there united, were crossed over James River, and a skirmish took place with the British, who had pursued us -- and so closely that considerable baggage was left -- the American troops not having time to convey it across the River. We were marched down James River through Richmond Virginia in pursuit of the British, who passed through Richmond before us, had burned the town. From Richmond, we still pursue d them to York Town, where we united with the main army, & were part of the troops to whom Cornwallis Surrendered. He states that he served out his second engagement of three months, and was discharged at the place of the surrender -- the place of the company to which he belonged being filled by some other Company raised for that purpose. He obtained no written discharge in either case. In his first tour, he was in no engagement, but was stationed the principal part of the term at what was called the Indian Bridge, not far from Petersburgh. He hereby relinquishes every claim whatever to a pension or annuity except the present, and declares that his name is not on the pension roll of any agency of any state or territory whatever Sworn to and subscribed the day and year afrd John [\] CUNDIFF And the said Court do hereby declare their opinion after the investigation of the matter, and after putting the interrogatories prescribed by the war Department, that the above named applicant was a revolutionary soldier in the Virginia militia and served as he states.
