DEED: Bayles EARLE heirs, 1816, Hopkins Co >> We have transcribed another one of the treasures that we brought back from Hopkins Co. This is a deed that lists the descendants of Bayles EARLE alive in 1816. Bayles EARLE was my 5th great grandfather. Mary (Polly) Prince EARLE who married Benjamin WICKLIFFE was my 4th great grandmother. We aren't positive of the deed book number. Jim and Debbie Powell Hopkins County Deed Book 2? Page 443 Whereas Bayles Earle late of the County of Hopkins State of Kentucky departed this life intestate leaving Elizabeth Earle who intermarried with William Oats, Samuel B. Earle Polly P. Earle who intermarried with Benjamin Wickliffe and Jane A. Earle his children and heirs at law to whom had descended the whole of the lands of said decedent, incumbered by the dower of Annie Earle the widow and relict of said decedent. And whereas we William Gordon John Slaton and James Howell were (on the application of said heirs) appointed commissioners by the worshipful court of Hopkins County at the November term of said court in the year 1813 for the purpose of making partition of the lands of said decedent (exclusive of the widows dower therein as the aforesaid which had been regularly assigned to her) amongst his several heirs above named and pursuant whereof we the said Gordon Slaton and Howell did on the 13th day of December 1813 go on and examine said lands of said decedent and laid off by metes and bounds the proportion of each pareimer(sic) therein according to right and justice and made report thereof to the said Hopkins County court at their December term in the year aforesaid which report was by the order of said county directed to be made of record and we the said Gordon Slaton and Howell empowered to convey to each parcenis(sic) his perspective proportion of said land agreeable to said report and the act of the general assayer in each case made and provided. Now this indenture witnessed that we the said Gordon Slaton and Howell commissioners as aforesaid for and in consideration of all the above premises have conveyed and by these presents do convey unto the said Jane A. Earle and her heirs and assigns forever one hundred and twenty three acres of land (allotted to her by our said report) lying and being in the County of Hopkins aforesaid on the waters of Pond River and bounded as follows (to wit) beginning at a maple white oak and spanish oak marked no. 3 running north 80 east 120 poles to a black gum and three dogwoods thence N 15 E 40 poles to a gum and white oak thence S 35 E 210 poles to two sweet gums thence S 75 W 140 poles to three hickories thence North 35 W 210 poles to the beginning with its appurtenances to have and to hold the said tracts or parcel of land with its appurtenances unto the said Jane A. Earle her heirs and to her and their only proper use and behoof and we the said Gordon Slaton and Howell commissioners as aforesaid the said tract or parcel of land with its appurtenances unto the said Jane A. Earle her heirs and against the claim or claims of them the said William Oats and Elizabeth his wife Benjamin Wickliffe and Polly P. his wife and Samuel B. Earle their heirs and against the claim or claims of all and every person and persons claiming as heir or heirs of the said decedent (but against the claim or claims of person or persons whatever) will warrant and forever defend. In testimony whereof we the said Gordon Slaton and Howell commissioners as aforesaid have hereunto subscribed our names and affixed our seals this day of 1816.
