Yes, 40 yrs. Are you acquainted with the lands: Yes, about 40 yrs. Were lands owned by Jacob? To best of my knowledge Is Jacob living or dead? He is dead I suppose. How long? About 45 years What lands did he own: Jacob's wife and son lived on land about 10-12 yrs after his death; land sold about 1855 and for 3-4 yrs they didn't live on it. I bought the land and got a deed from Henry Emmert, paid $300, don't know if it was ever recorded since the courthouse burned down while it was there. Is Henry a son of Jacob? Yes Is he living? No Are the lands you both the same as in the petition? Yes Do you or do you not own the lands? I lived there about 6-7 yrs and sold the land to Henry WAGNER, made a deed to him about the beginning of the war in 1861. Did Henry live on and control the land? He doesn't own them now, he mortgaged I think to Jefferson MOORE and Moore closed the mortgage and took possession about 20-30 yrs ago. Who has had control for the last 25-30 yrs? Jefferson MOORE Where did Jacob's children live at his death? Monroe Co. Did they reside there when you purchased the land? Did you know Margaret Emmert's father: No. Were you acquainted with Frank Emmert's father? Yes, name was Henry. Is there a record or papers on a suit in your office in which Henry as the Admr of Jacob as plaintiff and Margaret Emmert and the widow of Jacob and other children at law defendants? No papers Examine again for papers of an action between Jefferson MOORE etal vs Henry Waggoner. No papers. Have your records been destroyed, if so how and when? The office has been destroyed and all the records have been destroyed twice, both times by fire, the first during the war of 1861 and the 2nd on the night of Nov 16th, 1887. Are the records prior to 1863 and 1864 in existence? I don't think so, were burned and in 1887 only part of the records were burned. What is the distance from your office from your office in the Clerk's office? They are joined together. Will you examine the records to see if there is a record of deeds and mortgages recorded prior to 1863 and 1864? I haven't examined them so can't answer.
