Have you instituted since his death in the Monroe Circuit Court an action to secure or to sell the tract of land cited? Yes, I had it sold to satisfy a motgage which I had on the land. How long ago? 1862 or 1863. Who were the parties: Henry WAGGONER executed a mortgage to Joel MOORE and myself and we brought suit against the Administrator of Waggoner to sell land to satisfy the mortgate. Was the land sold: Yes Did you become the owner of the land at a sale? Yes Did the Court confirm the sale and make you a deed: Yes in 1862 or 1863. Was the deed recorded: I don't recollect but think it was destoryed or lost. My attorney W H BOTTS had the deed. Has a suit been instituted agaisnt the heirs: I understand there was. Do you know who brought suit: Henry Emmert, son of Jacob, about 40 years ago, about 12 yrs or more before I brought suit. Who was in possession of the tract of land when you and your brother filed suit? Henry Waggoner. Did you take possession of the land? Yes How did you take possession: I rented the home and barns out to different parties, sold fruit, cut and sold timber from the land, and began to pay the taxes on it. When: I took possession after the court made the deed, 1862-1863. Have you had possession of the land and occpied the same since the Court made the deed. Yes. Have you not for 20 or more yrs possessed and occupied the land and paid taxes, and do you now occupy them? Yes, paid taxes, and for more than 25 years have cut timber. Do you have the Sheriff's receipts for taxes. I have most of them. Does the deed still exist? If it does, I can't find it.
