Note: Since the questions are basically the same for each deposition, I will just answer the questions rather than repeating them. 69 years old, reside in Barren Co, farmer. Acquainted with Margret and Frank EMMERT, Alfred Emmert, Jessie Emmert, Felan Emmert, James D Emmert, Jane Emmert, Presha Emmert, Vina DIXON, David Dixon, Narcissa HIPPOCK, Ben J Hippock, Nancy Emmert, Jas J Emmert and Jefferson MOORE. Has known Jefferson about 40 years. Is acquainted with the land; adjoins the land I used to own and lived on for over 40 years. David ALMANY likely kept the land 2 years. Henry WAGGONER bought it from Almany. Waggoner likely mortgaged it to Jefferson Moore. Henry lived on it for some years after he bought it. Then Jefferson Moore closed his mortgage and had the land sold. He had the land advertised for sale, I read the advertisement. A few days later it was sold. Moore took possession of it and fixed up the fencing. He never lived on the land but rented it out to parties; I rented a part of it for 2 years. Moore took possession of the land about 1862 or 1863 and still had possession of it when I left Monroe Co in 1881. I rented it about the year 1870 or 1871 and cultivated it the close of the war of 1861. I had part of it rented for pasture for a year or two and he rented the rest to other parties during this same time. I learned of the land in 1859. Cross-examination: No, Jefferson never lived on the land. He rented part of it to me and sold me fruit off it 2 or 3 different times. Would you know if he was trespassing or meddling with the land of others. I would know. I saw the advertisement and heard the neighbors speak of the sale. I never saw him paying taxes on the land myhself. I don't know of my own knowledge that he rented the land except they told me they rented it from him. I have never herad of a contract between Moore and other renters. I never saw any mortgage. I know nothing about the mortgage. I don't know anything about a foreclosure. I just heard that Jefferson Moore had bought the land. I am not related to Moore. I heard from what others told me and I knew the land before Moore had it. I don't know how David Almanyh got the land, I would assume from Jacob Emmert or his heirs. Margaret is a daughter of Jacob Emmert. Closing: Jefferson Moore denies he purchased only the life estate in the dower in the homestead of the widow; he never has claimed said land adverse to any of the heirs or children, denies part of them when he took possession of the land were married women or under disability. Land was sold Monday 2 Feb 1891 and purchased by W E Maxey for $41.00. Jefferson Moore made exception to the sale of land made by G S SPEAR on 7 July 1891 because he said the land sold for only $41 when it was worth from $300-400. Margaret Emmert, Plaintiff and defendants came and made exception to the sale because: it was not advertised as required by law. Also that Moore was on the ground the day of the sale and defied the public openly and publically and in an open voice loud enough for the public to hear him to have anything to do with the sale or purchase of said land. He threatened to sue any and everone who participated in the sale. This prevented the purchasers and the public who were ignorant about the matter and cause the sale price to be sacrificed; should have brought $600. Prays that the sale be set aside and held for naught, and that a re-sale occur.
