From: KyArchives Sent: Sunday, February 15, 2015 11:38 AM To: Ky-Footsteps Subject: Fletcher.James-Fletcher.John.&.William.1825.Montgomery.DEED James Fletcher - John & William Fletcher February 28, 1825 Montgomery County KyArchives Deed Lulbegrud Creek Written: February 28, 1825 Recorded: February 28, 1825 Pages 438-439 This indenture made and entered into this twenty eight day of February in the year 1825 between John Fletcher and William Fletcher of the first part and James Fletcher of the second part of the County of Montgomery and State of Kentucky Witnesseth: That whereas their deceased ancestor William Fletcher in his last Will and Testament devised to his four sons John, James, Robert and William two tracts of land patented to the said William Fletcher, deceased situate lying and being in the County and State aforesaid on the waters of Lulbegrud Creek and the aforesaid John Fletcher and William Fletcher having bought out their said brother Robert Fletcher and the said John, James and William having came to a division of the greater part of said two tracts of their dec father one of which contains two hundred acres and the other two hundred and nineteen acres. It being hereby understood that a division of the whole is made except a small quantity now claimed by William Wilkerson under the claim of Thomas Stapleton which claim interfered with the claims of William deceased the aforesaid James and William retain their rights to the same and it is not intended that this division or no deed made in persuade. Thereof shall by any means or by any construction divert said James and William of their right to the part of their ancestors title which interfers with said William Wilkersons purchase of said Thomas Stapleton title from the said John Fletcher therefore in consideration of the foregoing premises and for the further consideration of one dollar in hand paid by the said James Fletcher to each of his said brothers John Fletcher and William Fletcher they said John and William have granted, bargained and sold and doth by these presents bargain, sell, convey and forever relinquish unto the said James Fletcher and assigns forever all the rights title, interest and claim of them the aforesaid John and William in and to the following boundary of land in both land part in both of the aforesaid claims of their said ancestor and part in the claim of said Thomas Stapleton it being apreed by all parties that the part in said Stapleton claim is hereby conveyed and relinquished to said James as fully and completely as that in his said ancestors and said James part being bounded as follows (to wit). Beginning at a stake on the side of a hill in Molleys line corner to Molly Wilkerson thence South forty seven deg E thirty two poles to a sugar tree in said Molley line corner to the aforesaid John Fletcher thence N forty one and one half deg E. One hundred poles to a stake near a drow another corner to said John Fletcher. Thence N thirteen deg E. forty one poles to a black ash other corner to said John Fletcher thence N thirty nine deg W one hundred thirty four poles to a stake another corner of said John in the line of old John Grear thence S seventy eight deg W seventy seventy poles to a red plum or bow in Caningtory line thence S forty three deg E with said Caningtory line sixty six poles to a walnut and cherry tree stump corner to said Caningtory thence with another of said Caningtory (on) line S forty three deg W thirty two poles to a box elder and one sugar tree in said line another corner to Holly wilkerson thence with his line S seventy deg E forty five poles to a sugar tree and elm on the side of a branch thence S eighteen deg E eleven poles to a stake S down a branch fifty seven polers to a set stone thence S fourteen deg W thirty one poles to the beginning containing ninety six acres on road and thirty seven poles be the same, more or less, to have and to hold the above bound tract or parcel of land unto the said James Fletcher and his heirs and assigns forever, together with its appurtenances from the aforesaid Robert and his heirs and it being the land wherein the said James now lives and the aforesaid John and William do hereby warrant the title hereby conveyed being the title or interest of them both and their aforesaid brother Robert Fletcher unto the said James his heirs do forever themselves and their heirs and all persons claiming from through or under them but from nor against no other person or persons claiming or claiming whatever it being distinctly understood that this is a Quit Claim Deed and said James declare himself content with the same. In testimony whereof the aforesaid John Fletcher and William Fletcher have hereunto set their hands and affixed them respective seals this day and year first above written.
