From: KyArchives Sent: Tuesday, August 13, 2013 8:00 PM To: Ky-Footsteps Subject: Fox.Titus.Revwar.1841.Hopkins.MILITARY-Pension Pension Revwar Hopkins County KyArchives Military Pension Pension TITUS FOX Revolutionary War State of Kentucky Hopkins County On this 12 day of March 1841 personally appeared before the Court for the County aforesaid ELIZABETH FOX a resident of the said County of Hopkins and State of Kentucky aged Seventy Eight years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provision made by the Act of Congress passed July 4, 1836. That she is the widow of TITUS FOX who was a private in the army of the Revolution that during the whole of his service in the United States his residence was in Wilkes County, North Carolina. Previous to her marriage with said TITUS FOX she had long been acquainted with him her residence not being more than Four miles from his. That she recollects he was gone from home in the service of the United States for Three months she thinks this occurred between One & Two years before her marriage with said FOX in this tour she always understood that he was a volunteer and that the service was mostly in the lower part of South Carolina in the neighborhood of Charleston. The said TITUS and herself were married on the 25th day of August 1780 and about one week after their marriage the said TITUS FOX started on another tour in which he was gone about Two months during this tour the battle of Kings Mountain was fought, he was not in the engagement he belonging to a corps of infantry who did not arrive on the ground until a few minutes after the surrender of the British he was in hearing of said battle. The next tour of any considerable length occurred in the winter of 1781-1782 in this he was gone over two months the precise time she cannot state during this tour he first child was born which happened on the 2nd January 1782. She thinks in this tour of service he went to Deep River (in North Carolina she thinks but is not positive). She further states during the period of the above tours and perhaps afterwards he was frequently gone on short tours against the Tories, some times a few days sometimes a week or more. She cannot state with any certainty the names or grade of the officers under which he served. She however recollects the names of some of them but their grade or the tours in which they commanded she cannot state. Here are some of their names: Benjamin Cleaveland who was always called Colonel William Lewis, Micajah Lewis, Joel Lewis, Samuel Johnson she thinks he was called Captain, Richard Allen when she first knew him he was called Captain afterward Major and after that Colonel. She further declared that she was married as before stated to the said TITUS FOX on the 25th day of August in the year Seventeen Hundred and Eighty that her Husband the aforesaid TITUS FOX died on the 22nd day of June 1825 and that she has remained a widow ever since that period, as will more fully appear by reference to the proof hereto annexed. Sworn to and subscribed on the day and year above written before the County Court for this County of Hopkins in the State of Kentucky as aforesaid. ELIZABETH FOX Her x mark State of Kentucky Hopkins County On this 14th day of September 1853, before me James A. Nisbet an acting Justice of the Peace within and for the County and State aforesaid personally appeared JESSE FOX who being sworn according to law, on his oath makes the following declaration for the purpose of obtaining the benefit of any act or acts of the Congress of the United States granting to the children of deceased Revolutionary soldiers a Pension to wit: That he is the legally appointed Administrator upon the estate of ELIZABETH FOX widow of TITUS FOX, lates of the County and State aforesaid, who was a Private soldier in the _________ line of the army of the United States in the war of the Revolution. That application has heretofore been made for a Pension and to the evidence on file with said application he refers for proof of service identity etc. He further declares that the aforesaid TITUS FOX died in the County and State aforesaid on the 21st day of June One Thousand Eight Hundred and Twenty Five; That his widow the aforesaid ELIZABETH FOX died in the aforesaid County and State on the Twenty Fourth day of September One Thousand Eight Hundred and Forty Five, aged about Seventy Eight years leaving the following named children to wit: ALLEN FOX aged Fifty years, JESSE FOX aged about Forty Seven years, DANIEL FOX aged about Sixty Five years at the time of his death five years ago, Mrs. AMELIA MEREDITH aged about Seventy years, Mrs. MARY SISK aged about Fifty Three years, Mrs. MALINDA MATTHEWS aged about Forty Four years, Mrs. SARAH MATTHEWS aged about Fifty Six years at the time of her death about Three years since, and JAMES FOX aged about Fifty Three years at the time of his death some Four years since. He further declares that the said TITUS and ELIZABETH FOX were married in Wilkes County North Carolina about the year One Thousand Seven Hundred and Eighty. That her name before her marriage to the said FOX was ELIZABETH WRIGHT. Jesse Fox Adm. Elizabeth Fox dec’d. Sworn to and subscribed before me this 12 day of September 1852. James a. Nisbet J.P. Orlean Bishop clk Washington, Oct. 12th 1852 Sir: Enclosed please find the declaration of the Adm. Of ELIZABETH FOX dec’d. widow of TITUS late of Ky. With ???????? Evidence. The claim was suspended for want of sufficient proof of marriage which I hope you will find satisfactorily supplied. I am very respectfully your obt. Servt. J.J. Coombs J.E. Heath Esq. Comm. Of Pensions The deposition of ANNE DAVIS aged Seventy Six years a citizen of Hopkins County Kentucky taken at the house of her son VINCENT DAVIS in said County on the 14th day of February 1844. Said deponent being duly sworn deposes and says that TITUS FOX lived at the house of her Father for about Two Years before he was married to ELIZABETH WRIGHT in Wilkes County North Carolina. That during the time he lived at her Fathers he went & served in the war of the Revolution and was gone about Three months that he was married in august the 25th day thereof she thinks in the year 1780 it was at any rate a short time before the Battle of Kings Mountain about one week after he was married, he started on a tour during which the said Battle of Kings Mountain was fought that he was at said battle & returned after the same was fought. In this four she thinks he was gone about Two months, she recollects that he was gone on a tour of service when his first child was born which was about Eighteen months after their marriage in this tour he was gone about Eleven weeks within the above times he was frequently out on short tours against the Tories but the times or length of the tours she cannot state. She does not recollect about the names of the Officers under which he served. She knows he was gone very near the times that she has stated first Three Months, Second Two months and Last Eleven weeks and that he was gone at other times in short tours. She understood from him and others who were in the service that he was in the service of the United States and she has no doubt of his having been a good brave & faithful soldier. She further states that she was present at the marriage of the said TITUS FOX and said ELIZABETH WRIGHT in Wilkes County North Carolina. She the said deponent is the Cousin of the said ELIZABETH WRIGHT who was married to the said TITUS that the said TITUS FOX died in this Hopkins County the date she cannot state leaving the said ELIZABETH his widow who is still his widow having never married since his death. And further saith not. Anna Davis Her x mark Also the depesition of Hannah Allen aged Seventy Four years a citizen of Hopkins County taken at her own house on the same day to wit: 14th February 1844. Said deponent being duly sworn deposes and says that she was acquainted with TITUS FOX in Wilkes County North Carolina that he served in the Revolutionary War. That he lived at her Fathers in said County of Wilkes for some time previous to the Battle of Kings Mountain, that he was married to ELIZABETH WRIGHT a short time before the Battle of Kings Mountain. She deponent was not present at the marriage but knows that said FOX and ELIZABETH WRIGHT his (her)? Sister ANNE DAVIS (who gave the above deposition) and others went from her Fathers house to another place in the neighborhood for the purpose of getting married and returned after the marriage all parties saying they had been married and she has no doubt of such being the fact. She has no doubt but that the statement of said ANNE DAVIS as to the marriage and the date of it is correct. She has no doubt either of the correctness of the other statements of the said ANNE DAVIS or to the service of the said TITUS FOX in the Revolutionary war given in her foregoing deposition. She deponent cannot recollect as to length of tours etc she said ANNE DAVIS was married to William Davis a very short time after the Battle of Kings Mountain and as said FOX & Davis served a good deal together she thinks her recollection would be more apt to be correct. Said deponent further states that TITUS FOX departed this life in Hopkins County (the date she cannot state) leaving the said ELIZABETH his widow who is still a widow never having married since his death. And further saith not Hannah Allen Her x mark Kentucky Hopkins County I Thomas W. Campbell a Justice of the Peace in and for the County of Hopkins do hereby certify that the foregoing depositions of Anne Davis and Hannah Allen were this day taken subscribe & sworn to before me at the places mentioned therein. Kentucky Hopkins County SS The Deposition of Ebenezer B. Sisk a resident of the County aforesaid aged Forty One years. This deponent being duly sworn deposeth and saith that he was long & intimately acquainted with TITUS FOX late of the County aforesaid, deceased. That said FOX departed this life at his residence in said County on the 21st or 22nd day of June in the year 1825. That said FOX died at an advanced age and wwas as this deponent understood from himself and others soldier in the Revolution. This Deponant further states that ELIZABETH FOX of said County is the widow of said TITUS FOX and is as this deponent has been informed and believing an applicant to the Government of the United States for a pension on account of the service of the said TITUS in the Revolution and further this deponent saith not E.B. Sisk State of Kentucky Hopkins County Sct. I Samuel Morton a Justice of the Peace in and for the County aforesaid do hereby certify that the foregoing deposition of Ebenezer B. Sisk was this day taken subscribed and sworn to before me I further certify that the said deponent Ebenezer B. Sisk is a credible person. Given under my hand the 22nd day March 1844 Sam Morton J.P. Kentucky Graves County SS The deposition of DANIEL FOX a citizen of the County aforesaid aged Seventy Eight years this deponent being first duly sworn deposeth and saith that he knew TITUS FOX that said TITUS was in the service of the United States in the Revolutionary War Three months under General Gates during which time Gates was defeated, he was also in service under Colonel Cleaveland and Captain Samuel Johnston at the time of the Battle of Kings Mountain deponent was with him in service under Captain Joel Lewis at the time of Bryants decoying his men of to the British and went in pursuit of them. Deponent and TITUS was also in service under Major Hargrove & Captain John Beverly against Col. Fanning and the Tories under him deponent further states that said TITUS FOX was married to ELIZABETH WRIGHT after Gates defeat and before the performance of the three last named tours and that said TITUS FOX was a resident of Wilkes County North Carolina when the above service was rendered he knows said TITUS FOX moved to Hopkins County Kentucky and is informed and believes died there leaving said ELIZABETH his widow & further deponent saith not. DANIEL FOX His x mark Kentucky Graves County Sct. Before the undersigned a Justice of the Peace in and for the County aforesaid this day came DANIEL FOX of sd. County who is known to me to be a credible person and subscribed and swore to the foregoing deposition given under my hand this 25th day of December 1843. Jos. G. Ervin Anderson State of Kentucky Hopkins County On this 20th day of May 1852 before me James A. Nisbet an acting Justice of the Peace within and for the County and State aforesaid personally appeared ANNE DAVIS aged 86 years, a resident of Hopkins Co. and State of Kentucky who being duly sworn according to law on her oath declared that she was present at the marriage of TITUS FOX and ELIZABETH WRIGHT in Wilkes County North Carolina in august 1781. That she was then about Fifteen years of age. That the said TITUS FOX served in the army of the Revolution for a considerable length of time that she does not recollect the names of the officers under which he served but thinks he served under Colonels Allen and Cleveland in North and South Carolina. That the said TITUS FOX died in Hopkins Co., Ky on or about the 21st day of June 1825. That his widow ELIZABETH FOX died in the County and State aforesaid on the 24th day of Sept. 1845 and that she remained a widow from the time of the death of the said TITUS FOX dec’d. until her own death. That she has lived a near neighbor to the said TITUS and ELIZABETH FOX deceased ever since their childhood and up to the time of their death. That she does not believe there were any records of marriage kept in the State of North Carolina so early as 1781. ANNE DAVIS Her x mark Sworn to and subscribed before me this 20th day of May 1852. And I further certify that Mrs. Anne Davis is a respectable resident of the County and State aforesaid and that I believe her to be of the age above stated and that she is of sound mind. James A. State of Kentucky Hopkins County On this 15th day of May 1852 personally appeared before me James A. Nisbet an acting Justice of the Peace within and for the County and State aforesaid ROBERT SISK aged 75 years who being duly sworn according to law on his oath declares that he was personally acquainted with TITUS FOX dec’d. (who at the time of his death was a resident of Hopkins County Ky.) while he lived in Wilkes County N. Carolina in the year 1790. That the said TITUS FOX dec’d was always respected and believed to have been a soldier in the army of the Revolution. That the said TITUS FOX dec’d. died in Hopkins Co., Ky, on the 21st day of June 1825. That he was also personally acquainted with his Wife ELIZABETH FOX from the year 1790 until her death. That her name before her marriage was ELIZABETH WRIGHT that she died in Hopkins County Ky., on the 24th day of Septr. 1845 aged about. That the said TITUS FOX and ELIZABETH FOX dec’d. lived together as man and wife during the entire time of his acquaintances with them and were always reputed and believed to be such. That he knew the said TITUS FOX dec’d before his marriage, but has no distinct recollection of the time it took place he having been at the time very young. That he never had any doubt of their having been lawfully married. That he is personally acquainted with all the surviving children of TITUS and ELIZABETH FOX and that they are highly respectable and worthy citizens. That the said TITUS and ELIZABETH FOX dec’d during his acquaintance with them sustained unblemished characters. That he has lived near neighbor to them ever since his childhood. Monsarrat of the City of Louisville and State of Kentucky my true and lawful Attorney for me and in my name to prosecute against the Government of the United States the claim which the heirs of the aforesaid ELIZABETH FOX deceased have to a pension on account of the military services of her Husband the aforesaid TITUS FOX in the army of the United States in the war of the Revolution. And my aforesaid attorney or such other person or persons as he may substitutes is hereby fully authorized to demand at the proper Department at the City of Washington all investigation of the right of said heirs to a pension and to do any and all things necessary and proper to substantiate said claim, which when done my said Attorney is hereby authorized to receive the certificate of Pension which may issue in satisfaction of said claim deed which I request may be made payable at the agency in the city of Louisville, Ky. I hereby revoke any former power or powers of Attorney given by me to any other person or persons whomsoever; and with my aforesaid Attorney and him only do I desire the Pension Office to hold correspondence touching said claim. Nisbet an acting Justice of the Peace within and for the County and State aforesaid personally appeared JESSE FOX Administrator upon the estate of Mrs. ELIZABETH FOX and acknowledged the foregoing Power of Attorney to be his voluntary act and deed for the purpose therein specified. I hereby further certify that letters of Administration upon the estate of Mrs. ELIZABETH FOX widow of TITUS FOX late of the County and State aforesaid have been granted to JESSE FOX of Christian County and State of Kentucky and that said letters of administration have never been annulled but are now in full force and effect. Be it remembered that at a Court continued & held for the County aforesaid on Tuesday the 12th day of March 1844 the following entry was made in the minutes of said Court viz: “This day ELIZABETH FOX of the County widow of TITUS FOX dec’d a Revolutionary soldier of the United States exhibited swore to and subscribed in open Court her declaration marked (A) in order to obtain the benefit of the Act of Congress of July 4, 1836, entitled an act granting half pay to widows or orphans where Husbands and Fathers have died of wounds secured in the military service of the United States in certain cases and for other purposes” which is ordered to be certified accordingly” I Samuel Woodson Clerk of the Court for the County aforesaid do hereby certify that the foregoing is truly transcribed from the minutes of said Court. Be it remembered that at a County Court continued & held for the County aforesaid at the Court House in Madisonville on Tuesday the 14th day of September 1852 Newton Headley presiding Judge being present and presiding two entrees were made in the minutes of the proceedings of said Court in the words of ??????? following to wit: “Administration of the estate of ELIZABETH FOX dec’d granted to JESSE FOX who made oath to and with Huston g. Hankins his surety entered into covenant as required by law.” “Satisfactory proof was presented to the Court that TITUS FOX late of the County and State on the Twenty First day of June One thousand Eight Hundred and Twenty Five and that his widow ELIZABETH FOX survived him and remained a widow until her death which occurred in Hopkins County Kentucky on the Twenty Fourth day of September One Thousand Eight Hundred and Forty Five leaving the following named children to wit: ALLEN FOX, JESSE FOX, DANIEL FOX, Mrs. AMELIA MEREDITH, Mrs. MARY SISK, Mrs. MALINDA MATTHEWS, Mrs. SARAH MATTHEWS and JAMES FOX and the same is hereby entered of record upon the books of this Court” I Orlean Bishop Clerk of the County Court for County of Hopkins aforesaid do certify that the foregoing are truly transcribed from the minutes of the proceedings of the said Court, as the same now remain in my office.
