WILL: Franks, 1882 - Grant Co Will of Barnette S. Franks Grant County, Ky. I, B. S. Franks, of the County of Grant and the State of Kentucky make and publish this my last will and testament, hereby revoking all former wills made by me. First, after my just debts and funeral expenses are paid, I give and bequeath to my wife Lucretia Franks all of my personal estate including stock of all kinds, household goods and furniture and implements money and provision notes and promissory notes, except on D. D. Clements, one note on my son, F. M. Franks, one note on my son, Benny Franks. This I give her to enable her to raise, educate and provide for my younger children. Second, of my land I give and bequeath to my said wife, Lucretia Franks, during her natural life, the following described boundary. Be- ginning on Sugar Creek Road at James Smith's line at the mouth of Vauter's Lane, thence westwardly with the road to a point in said road at the head of a drain, a short distance to the west of my barn, thence in a west- wardly direction with the drain and branch as to divide the water in said branch, to Vauter's, thence, east with Vaughn's line and southwardly with Vauter's line to the beginning which boundary continues about 75 acres, this I give to her during her natural life at her death to be equally divided amongst all my children and heirs living at that time. The remainder of my land, I desire shall be divided amongst all my children and heirs living at the time of my death or that may be born after my death charging to each of them what they may be owing me at that time. That is reducing the amount of land allotted to each by any amount they may be owing me, charging Mary E. Clements with the note held by me on D. D. Clements, her husband. In making this division, the commissioners shall lay off to my son, F. M. Franks, his share in the corner next to the land of Bailey Beach and Price Beach, and the balance of the land on the northside of the road shall be divided by lines running as near east and west as convenient, and the lots shall be apportioned to my children, except to my son, F. M. Franks. Beginning at the north side and giving the oldest children the first lot on the north. The second child, the second lot and so on, so that the younger children shall get the land on the south of the road and the nearest road on the north side a gate way shall be left up the ridge so that all the lots shall have an outlet to the road. Third, my children that have already married have been given by me a horse, saddle and bridle, a cow and bed and bedding or property equal in value thence to, and I desire that my wife shall give to each of my children as they marry or arrive at the age of 21 years, property of like value and should she die before my family is raised, I desire that the provision shall be made for each of them before a final division is made. To my son, Benny Franks, and daughters Ida and Artimessia, I have already given them a horse, saddle and bridle intended by this provision for them. Fourth, in case I should die when there is a crop growing upon my land, I desire that there shall be no division of land until after the crop if harvested and saved which shall belong to my wife as a part of my personal estate. Fifth, I desire that my wife, Lucretia Franks, shall be executrix of this, my last will and that no security as such shall be required of her. Sixth, in making the division of my land, I desire that William M. Vallandingham, T. J. Conrad and John T. McClure be appointed commissioners to make said division. Franks, deceased, was produced in open court on the 8th day of January 1883 and the said last will and testament was duly proven according to law by the oaths of John T. McClure and A. N. Jones and the 10th of January 1883 by the oaths of F. M. Smith and Eliza Tomlin, subscribing witnesses thereto and the said writing is now admitted to be the last will and testament of B. S.
