Written: April 20 1830 Recorded: April 20 1830 PAGE 117 DEED BOOK K WASHINGTON COUNTY KENTUCKY 1829-1831 This indenture made and entered into this twentieth day of April, 1830 Between Thomas McCarty and Mary his wife [late Inman] one of the heirs of Jesse Inman Deceased of the county of Washington and State of Kentucky of the one part and Jacob Frowman of the county and State aforesaid of the other part [**tueseth?] that the said McCarty and wife forward in consideration of the sum of forty six dollars to them in hand paid the receipt where of they do hereby acknowledge have given granted, bargained, sold and do by their presence give, grant, bargain, sell, release, convey and confired unto the said Frowman all their Right Title and Interest in and to, two Certain Tracks, pieces or parcels of land situate lying and being in the County of Washington adjoining each other on the waters of the Beech Fork, for greater certainty references is made to a Patent from the Commonwealth of Kentucky to said Inman, and to a deed from Thomas P. Moore the patent calls for fifty acres and the deed for seventy one acres or there abouts To have and to hold the said Interest of the said McCarty and wife which is the one tenth part to him the said Frowman and to his heirs or assigns forever and the said McCarty and wife do further conveyant provise grant and agree to and with the said Frowman his heirs be that they will warrant and defend the one tenth part of said two tracks of land from and against the claim or claims of themselves and their heirs and from and against the claim or claims of all and every other person or persons claiming or to claim the farm [?] in any manner whatever In witness whereof the said McCarty and wife have hereunto set their hands and seals the date above written. I John Hughes Jr. Clerk of the County Court for the County aforesaid do hereby certify that on the day of the date thereof, This indenture was acknowledged before me in my office by the written received Thomas McCarty to be his all and deed and the said Mary McCarty having been examined by me previously and apart from her said husband declares that she did freely and willingly seal and deliver the said writing and wishes not to retract it and acknowledged the said writing again hereon and explained to her to be her act and deed and executed that the [save?]way be recorded which is accordingly done in Deed Book K page 117. Moore, was the Attorney of Justin McCarty, father of Thomas. Likely this 71 acres is Thomas's part from Justin's Estate. I understand reading this deed, as saying that Thomas & Polly still keep 1/10 of the total 121 [+ -] acres, and that Frowman nor his heirs can claim this 1/10th.
