Item. I have heretofore given to my Son Thomas T. Garnett by way of advancement the tract of land on which he now lives purchased by me from William Newell and Benjamin H________ at Five thousand dollars, also a Negro boy named Edmund, a horse saddle and bridle, bed and furniture, two cows and salves, which gifts I now confirm, I also give and bequeath to him the tract of land known as the Blair tract he paying the cost of the suit with Blairs heirs, with which tract of land he is not to be charged in the distribution of My estate. Item. I have given to my Son Larkin Garnett by way of advancement Four thousand three hundred dollars, and a Negro boy named Willis, one bedstead bed and furniture, one horse saddle and bridle, and two cows and calves. I also give and bequeath to him the tract of land known as the Woods place at Fifty dollars an acre to be paid for in one and two years after my death. Item. I have given to my Son Andrew Garnett by way of advancement one Negro boy named Ben, one bedstead bed and furniture, one horse saddle and bridle, two cows and calves. I also give and bequeath to him the tract of land on which he lives known as the Web or Clarkson place at thirty dollars an acres payable at My death, from the price of which, is to be deducted the Sum of Five thousand dollars intended as an advancement to him and the further sum of Six thousand One hundred and ninety dollars already paid by him towards said land, the balance to be paid at my death. Item. I have given to my Son William Garnett by way of advancement one Negro boy named Lewis, one bedstead bed and furniture, one horse Saddle and bridle and two cows and calves. I also give and bequeath to My Son William Garnett My Gold Watch and Chain and My interest in the Thrashing Machine and desire that the burying ground on the land desired to him be kept for a family burying ground. Item. I have given to My daughter Nancy Caldwell, by way of advancement Five thousands dollars, one Negro girl named Zertelda, one Negro boy named Dudley, one cow and calf and one Sett of Silver Spoons. I have estimated _____ at three hundred and fifty dollars. Item. I have given to My daughter Sally King by way of Advancement one thousand dollars, one Negro Girl named Mary, one bedstead bed and furniture, one cow and calf, one Sett of Silver Spoons, I have also given her the further sum of one thousand two hundred dollars and a Negro girl named H_____ estimated at three hundred and fifty dollars amounting in all to Five thousand five hundred and fifty dollars. Item. I have given to My daughter Eliza Firman by way of advancement One thousand dollars and have given to My Son Thomas T. Garnett and William Garnett to be paid in trust for my granddaughter Eliza Firman in the Manner herein after mentioned one Negro girl named Amanda and her two children Lucy & Jini, also a Negro named Lavina and her child which I estimate at three hundred and fifty dollars and I have heretofore lent her husband Casey Firman two hundred and fifty dollars and the further sum of three hundred dollars. I have also heretofore given to My daughter Eliza Firman One bedstead bed and furniture and one Sett of Silver Spoons. I also give and bequeath to Said trustees to be held in trust as foresaid five hundred acres of land situated in Marion County in the State of Missouri. Eighty acres of which was purchased at Sherriff’s Sale and was called the Snell tract, the other hundred and twenty acres was purchased of Nesbit, which two hundred acres of land I +++++ mate at Twelve hundred and fifty dollars amounting in all to two thousand eight hundred dollars. I gave to my deceased daughter Polly Roberts by way of advancement one Negro girl named Roda, one bedstead bed and furniture, one cow and calf, one horse Saddle and bridle, one Set of Silver Spoons, One Bureau also a Negro girl named Mary which I estimate at three hundred dollars and five hundred dollars in money, _____ I desire My executors to sell and convey that part of my land lying North of the Beaver road adjoining Johnsonand Taylor Supposed to be from Ninety to One hundred acres and known as My upper place. Item. It is my will and desire that my Slaves not here in Cifore disposed of be divided among my children namely Thomas T. Garnett, Larkin Garnett, Andrew Garnett, William Garnett, Nancy Caldwell, Sally King, Eliza Firman, and in the division that Charlotte and her three children namely Nelson, Joshus and Hannah go together in the same lot, and that Charlotte have the privilege of chosing to which of said children she will belong and as in Said division the lots cannot be made of equal value. I desire that those who get lots of inferior value be paid out of the residue of my estate Such sums in money as will make them equal, and that Such sum be paid to the children of my deceased daughter Polly Roberts as will make them collectively equal to each of my other children in the division of the Slaves. Item. In all that part of my estate given to my daughter Eliza Firman either as an advancement or by the provisions of this Will. I give to my Son Thomas T. Garnett and William Garnett in trust for the use and benefit of my Said daughter Eliza Firman for and during g=her natural life, without being Subject to the control of her husband or liable for his debts, and said Trustees and the survivors are invested with the power from time to time and as they may deem necessary with the consent of my daughter Eliza Firman to barter exchange, Sell or Convey any part or portions of Said trust estate and if by there thought expedient to reinvest the proceeds in Such way as may by them be considered for the advancement or convenience of my Said daughter and at her death the rest and residue of Said trust estate to be equally divided among her children Share and Share alike. Item. It is my will and desire that the real and residue of my properly be Sold and equally divided among my children named Thomas T. Garnett, Larkin Garnett, Andrew Garnett, William Garnett, Nancy Caldwell, Sally King and Eliza Firman and the children of my deceased daughter Polly Roberts to take the share of their mother with my aforesaid children and if either of Said children Shall die under twenty one years of age without issue the Survivor or Survivors to take the share of Such deceased child or children and if they shall all die under twenty one years of age without issue, then their Legacies under the provisions of this Will to lapse and fall into the residue of my estate, but in Ma ? Sally King said division Larkin Garnett is to be charged with two thousand three hundred dollars, Nancy Caldwell with three hundred and fifty dollars, Eliza Firman with Eight hundred and Sally King with Five hundred and fifty dollars and before any divisions of the residue, the children of my deceased daughter Polly Roberts are to be paid twelve hundred dollars to make up the two thousand dollars given to each of my children as an advancement. Item. I desire my Rail Road stock to be sold and transferred by my Executors at Such time as they may think expedient. Lastly I nominated constitute and appoint my Sons Thomas T. Garnett, Larkin Garnett, William Garnett.
