That the said Adam Shepherd for & in consideration of one hundred pounds to him in hand paid the receipt of which he does hereby acknowledge have Granted bargained & sold and by these presents do grant bargain & sell [silen] and Confirm to the Said Garten his heirs & assigns forever a certain tract or parcel of land containing by estication [estimation ?] two hundred acres situate lying & being in the County of Washington and on the main South fork of the rolling fork of Salt river & being a part of a fifteen hundred acre survey where the said Uriah Garten now lives & bounded as follows (Towit) beginning at Thomas McTyres upper corner on the north side of the fork at a hickory Sugar tree & dogwood thence with his line South eight degrees west one hundred & thirty five poles to a Buckeye Sugartree & dogwood in the old line thence North fifty degrees East one hundred poles to an ash & Sugartree thence south fifty five degrees east thirty six poles thence south seventy five degrees east sixty poles to a hickory & sugartree thence east one hundred & sixty two poles to a beach in the old line thence north eighty degrees east one hundred & fourteen poles to two sugar trees thence sixty degrees west twenty poles thence south eighty degrees west one hundred & forty poles to a poplar & hickory thence south sixty degrees west forty four poles thence north eighty degrees west ninety six poles thence north seventy two degrees west to the Beginning. To have and to hold the said tract or parcel of land with all and Singular its appurtenances unto him the Sd Uriah Garten his heirs & assigns forever and the Sd. Adam Shepherd for him self his heirs Exers. & Admors. Do farther covenant to & with the said Uriah Garten that he will forever warrant and defend the said tract or parcel of land with all & Singular its appurtenances unto him the sd Uriah Garten his heirs & assigns forever from and against the claim of him the said Adam Shepherd & free & against the claim of any other heirs & all persons Claiming by through or under him & farther Should the said land be taken from the sd. Uriah Garten his heirs or assigns by any other claim whatever that then & in that case the sd. Adam Shepherd shall refund unto the said Uriah Gartan the Consideration money aforesaid with the lawful interest thereon. In Witness whereof I the said Adam Shepherd have hereunto set my hand & seal the day and year first above written. John Reed Clerk of the County Court for the County aforesaid so hereby Certify that on the 27th day of October 1803 this Indenture was proved before me in my office to be the act and deed of the Within named Adam Shepherd by the oath of William Martin & Travis Coppage two of the subscribing Witnesses thereto: And that on the day of the date hereof the same was fully proved by the oath of Alexander Coppage and other subscribing Witnesses thereto and thereupon admitted to Record.
