McGinnis - Et al Hackney August 3, 1877 Warren County KyArchives Deed Written: August 3, 1877 Recorded: August 7, 1877 Warren County, Kentucky Deed Book 47, pages 523-525 This Indenture made and Entered into this 3rd day of August 1877 between Jerry Hackney and his wife Nancy Hackney by John E. DuBose Master Commissioner of the Warren Circuit Court of the first part and Robt. K. McGinnis of the second part. Witnesseth That whereas at the July Term 1876 of the Warren Circuit Court of the State of Kentucky, a Decree was rendered by said Court in the suit of Thos. H. Smith et ux plantiffs against Jerry Hackney &c defendants directing a Sale of the property hereby conveyed and whereas the property was offered for sale in pursuance of said Decree by the Commissioner appointed to make said Sale when Thos. H. Smith & wife became the purchaser thereof at the price of one Hundred & thirty five Dollars and said sale having been reported to said Court and the said Court after being fully advised confirmed said report and at its January Term 1877 Directed a Conveyance of the property herein Described to the made to the Grantee herein the purchase having direct a conveyance of the property to be made to him. Now therefore for and in consideration of the premises and the further consideration of the payment in full of the purchase money the receipt whereof is hereby acknowledged the parties of the first part acting through and by the undersigned as Commissioner aforesaid do hereby give grant Sell alien and Convey all their right title and interest to and in the following described tract or parcel of land lying being and Situate in the County of Warren and State of Kentucky and Described and bounded as follows to wit: being one half of a one acre lot deeded to deft. Hackney by Covington agent for Johnson, lying on the bluff of Big Barren River in Warren County at Delafield[?] there being a forty foot Street between said lot and said river on the top of said bluff and another Street bordering on the front of said lot on the opposite Side thereof from Said bluff and next to Bowling Green said lot to be divided in the center by a line running through it from one of said Streets to the other and running at right angles with said front Street and towards said river bluff and the half of said lot lying on the upper side towards the Double Springs landing and being the half recently inclosed by a new fence Erected by Robert McGinnis is the lot hereby Conveyed but this conveyance does not include Either of said Streets The Conveyance heretofore made by the Master Commissioner by order of the Court herein and recorded in the clerks office of the Warren County Court is Set aside and this conveyance is made in lieu thereof. For a more particular Description of the property reference is made to the papers in the suit of Thos. H. Smith &c vs. Jerry Hackney &c in Warren Circuit Court. To have and to hold said property with all its appurtenances unto the said part of the second part his heirs and assigns forever, with such warranty of title as can be lawfully made in pursuance of the Decree and proceedings aforesaid. Hines Clerk of the Warren Circuit Court do hereby certify that this Deed from Jerry Hackney and his wife Nancy Hackney by John E. DuBose Master Commissioner of said Court to Robert McGinnis was on the 3rd day of August 1877 presented in open Court by John E. DuBose Master Commissioner and was by him duly acknowledged to be his act and deed. And the said Deed having been Examined by the Court was approved and confirmed and so endorsed by the Judge and ordered to be transmitted Duly certified to the Clerk of the Warren County Court for record which is now done accordingly.
