Harper.Robert.1870.Fleming.WILL Will of Robert Harper (1870) Fleming Co., Will Books Book M page 622 I Robert Harper of the County of Fleming and State of Kentucky being in my Eighty fifth year of age and being of sound mind and memory and desiring to dispose of by will of all my property of every kind do this 19th day of January 1870 make and ordain the following as my last Will and Testament hereby revoking all former wills First I will and desire to my Wife Margaret Harper during her natural life all my property real personal and mixed to be held and used by her to her use during life Second Having this day sold and conveyed to my Son William Harper Ninety six acres of my farm for the consideration therin named I do by this will ratify said deed and do by this will devise to my said son William Harper all the rest and residue of my lands supposed to be two Hundred and ninety acres to him said William and his heirs and assigns forever charged however with the following sums of money to be paid by him after the death of myself and wife and in the event of my Daughter Mary McIlvains death to be paid to her children in equal proportions and also to pay to my Daughter Elizabeth Cowan or her children the like sum of Twelve hundred and fifty dollars to be paid in Two years after the death of myself and wife and to pay to my Daughter Margaret Kirk the like sum of Twelve Hundred and fifty dollars this sum to be paid in three years after the death of myself and wife. Third I have heretofore made advances to my Daughter Mrs. McIlvain Mrs. Cowan and Mrs. Kirk and to the Mother of my Grand Daughter Rosetta Darnall and to Rosetta Darnall, and shall at once proceed to make advancements to my Daughter Mrs Kirk and my Grand Daughter Rosetta Darnall which will make them as I design and desire all equal and although I have heretofore advanced my Son William Nothing I estimate the land herin devised to him after paying the sums charged as making him up equal to my other children and grand daughter Rosetta Darnall and I now direct that should I by any event be prevented from advancing Mrs Kirk and Mrs Rosetta Darnall so as to make them equal with Mrs Cowan and Mrs Mc Ilvain I direct my Executor out of my estate so to do Fourth I devise any and all that may remain if any of my estate after the death of myself and wife to be equally divided between my Daughters Mary McIlvain, Elizabeth Cowan Margaret Kirk, my son William Harper and my Grand Daughter Rosetta Darnall to them or their heirs Lastly appoint my son William Harper Executor of this my Last Will hereby investing him with full power to execute the same. Johnson William Garey It appearing that a necessity exist therefor at a Special Term of the Fleming County Court held on the 8th day of April 1871 An instrument of writing purporting to be the last Will and Testament of Robert Harper dec'd was produced in open Court and duly proven by the oaths of LW Andrews and Chalres E. Johnson attesting witness thereto to be the last Will and Testament of said decedent acknoledged signed and sealed in their presence whereupon the same is duly received as the last will and Testament of said decent and is ordered to be recorded which is done Attest M.
