From: KyArchives [Archives@genrecords.org] To: Ky-Footsteps Subject: Hobbs.Noah-Walters,.Sills,.Jenkins.Et.Al.1848.Bullitt-Spencer.DEED Noah Hobbs - Et al Walters, Sills, Jenkins October 16, 1848 Bullitt-Spencer County KyArchives Deed Written: October 16, 1848 Recorded: November 2, 1848 Deed - WALTERS to HOBBS Deed Book L, Page 335 Other names mentioned: SILLS, JENKINS, HOBBS, HOMAN, CILLS, KING This Indenture made and entered into this 16th day of October 1848 by and between Tolbert WALTERS and Miranda WALTERS his wife of the first part; David SILLS and Elizabeth SILLS of the second part Barshaba JENKINS of the third part: And Noah HOBBS of Spencer County Ky of the fourth part Witnesseth: that whereas the said WALTERS and wife of the first part own in fee three shares of the heirs of Matthew HOMAN decd in a tract of land in Bullitt County Ky, and whereas the said Elizabeth CILLS formely Elizabeth HOMAN and one of the heirs of said HOMAN owns the remaining share in said land and whereas the said Barshaba JENKINS late Barshaba HOMAN widow of said Matthew HOMAN decd is entitled to Dower in said tract -- Now these presents Witnesseth that the said Tolbert J WALTERS and Miranda his wife and the said David CILLS and Elizabeth his wife and the said Barsheba JENKINS (late Barsheba HOMAN) have this day for and in consideration of the sum of five hundred and eighty dollars being the sum of ten dollars per acre to them in hand paid by the said Noah HOBBS the receipt whereof is hereby acknowledged, have granted bargained and sold and by these presents do sell and convey unto the said HOBBS a tract of fifty eight acres of land in the County aftd on the waters of Dutchman creek and bounded as follows viz: Beginning at a stake (being S 77 degrees W 20 links from a large sugar tree in the corner of a lane thence S.81' 40' (for 82 degrees) E 43-1/2 poles to a stake thence N.8 degrees E 17-1/2 poles to a black walnut marked for a corner in the corner of a lane thence S 80-1/6 E.67-4/10 poles to a stake near an ash stump on the north side of a __mp branch thence S.6-3/4 W 89-3/4 poles to a beech marked for a corner D.L.C.R. thence a straight line to a white oak stump supposed to have then the corner called for in KINGS old line -- containing fifty eight acres be the same more or less together with the appertenances thereunto belonging. to have and to hold the same to him the said HOBBS and his heirs forever and the said WALTERS & wife hereby covenant & agree with the said HOBBS to warrant and defend the portion herebyconveyed by them towit the undivided three fourths aforesaid -- from themselves and from the claims of any and all persons claiming the same -- and the said SILL and Elizabeth SILL his wife make the like covenant in regard to the one fourth so conveyed by them and the said Barsheba JENKINS hereby releases and relinquishes any and all claims she may have to dower in the aforesaid tract -- Given under the hands and seals of the grantors the day and year above written Tolbert WALTERS Seal Maranda WALTERS Seal her Elizabeth SILLS Seal mark her Barshaba JENKINS Seal mark State of Kentucky Bullitt County Towit I Noah C Summers clerk of the County Court for the County aforesaid hereby certify that this deed from Talbot WALTERS and Maranda WALTERS his wife, Elizabeth SILLS and Barshaba JENKINS to Noah HOBBS was the 16th day of October 1848 produced to me in my office and acknowledged by the said Talbot WALTERS and Barshaba JENKINS to be their act & deed and the said Maranda WALTERS and Elizabeth SILLS being examined by me seperately and apart from their said husbands declare that they did freely and willingly seal and deliver said deed, and wishes not to retract it -- and acknowledged said deed, again shown & explained to them to be their voluntary act and deed, and consented that the same might be recorded: whereupon I have truly recorded said deed and the certificate in my said office this 2nd day of November 1848 Att Noah C SUMMERS C.B.C.C.
