From: KyArchives Sent: Friday, March 14, 2014 10:25 PM To: Ky-Footsteps Subject: Logan.Hugh-Hubbard.Et.Al.1829.Garrard.DEED Hugh Logan - Et al Hubbard September 21, 1829 Garrard County KyArchives Deed Written: September 21, 1829 Recorded: September 21, 1829 Garrard County, Kentucky Deed Book K, pages 153-154 Examined and Delivered Oct 18 1832 This Indenture made this twenty first day of Sept in the year of Christ one thousand eight hundred & twenty nine by and between Moses Hubbard executor of John Hubbard deceased and Jaley Hubbard both of the County of Garrard and State of Kentucky of the one part and Hugh Logan of the County & State aforesaid of the other part. Witnesseth that whereas John Hubbard deceased, late of Garrard County, did on the 19th day of December 1826, make and publish his last will and testament which since the death of him the said John has been admitted to and is now of record in the office of the Garrard County court and refered to and in his Said will of which he appointed the afsd. Moses Hubbard and Jaley Hubbard his executors the last of whom however has failed and refused to qualify as such, devised to the said Jaley Hubbard then his wife the tract of land on which he the Said John then lived in Garrard County during her natural life or state of widowhood, and empowered and licensed her the said Jaley to Sell any part or the whole of Said tract of land, if she should think proper and make a full and complete title to the Same, now this Indenture witnesseth that the Said Moses Hubbard executor of the last will and testament of John Hubbard dec'd and the said Jaley Hubbard for and in consideration of the Sum of ninety one dollars and seventy one cents to them the said Moses and Jaley in hand paid, the receipt of which they do hereby acknowledge, have bargained Sold and enfeoffed unto the said Hugh Logan his heirs and assigns forever a certain tract or parcel of Land lying and being in the county of Garrard and state of Kentucky on the waters of Lick creek, being a part of the Tract devised to the Said Jaley by John Hubbard deceased as above mentioned, and containing by estimation Eleven acres one rood and thirty Six poles and bounded as follows to wit, Beginning at a stake on Said Logan's former line, two locust Saplins, pointers, thence N83°E 41 poles to a stake in a hollow thence up the hollow N7½°W 37 poles to a Stake in James Finnell's line thence with his line N53°W 31 po. to Said Finnell's corner on Logan's line (an elm) thence with Said line S2¼°W 65½ poles to the Beginning, together with all and Singular the Appurtenances thereunto Belonging to have and to hold the Same, with the appurtenances to him the said Hugh Logan his heirs and Assigns forever and the Said Moses and Jaley do further covenant that the Said Jaley is Seized of an indefeasible fee simple title to the Said land and empowered to Sell the Same and further for themselves their heirs and executors &c. they covenant the title to Said Land to the Said Logan his heirs and assigns forever against all claim or claims whatsoever to warrant and forever defend by these presents. Letcher clerk of the County court for the county afsd. do hereby certify that the foregoing deed of conveyance from Jaley Hubbard and Moses Hubbard to Hugh Logan was produced to me in my office on the 21 day of Sept 1829 and acknowledged by the Said Jaley & Moses to be their act & Deed for the purposes therein mentioned and the Same together with this certificate is truely admitted to Record.
