From: KyArchives Sent: Friday, March 14, 2014 11:59 PM To: Ky-Footsteps Subject: Logan.Hugh-Hubbard.Jaley.1834.Garrard.DEED Hugh Logan - Jaley Hubbard September 15, 1834 Garrard County KyArchives Deed Written: September 15, 1834 Recorded: September 15, 1834 Garrard County, Kentucky Deed Book L, page 314-315 (398) Jaley Hubbard &c to Logan This Indenture made this 15th day of Sept in the year of Christ 1834 between Moses Hubbard and Jaley Hubbard Exors of John Hubbard dec'd of the county of Garrard and State of Kentucky of the one part and Hugh Logan of the County and State afsd. of the other part Witnesseth that whereas John Hubbard dec'd late of Garrard County did on the 19th day of Dec 1826 make and publish his last will and testament which since the death of him the said John Hubbard has been admitted to and now is of record in the office of the Garrard County Court and refered to and in his said will of which he appointed the afsd Moses Hubbard and Jaley Hubbard his Exors the latter of whom however has failed and refused to qualify as such, devised to the said Jaley Hubbard then his wife, the tract of land on which he the said John then lived in Garrard County "during her natural life or state of widowhood" and empowered and becaused her the said Jaley to sell any part or the whole of said tract of land if she should think proper and make a full and complete title to the same, now this Indenture Witnesseth that the said Moses Hubbard Exor of the last will and testament of John Hubbard dec'd and the said Jailey Hubbard for and in consideration of the sum of Thirty one dollars and fifty cents to her the said Jailey in hand paid the receipt of which is hereby acknowledged have bargained sold and enfeoffed and do by these presents bargain sell and enfeoff to the said Hugh Logan his heirs and assigns forever a certain tract or parcel of land situate in the County and State aforesaid on the waters Lick Creek a branch of Pt. Lick being a part of the tract devised to Jailey by John Hubbard dec'd as above mentioned and containing by survey Five and one quarter acres which is bounded as follows: Beginning at a stake in a hollow and young Black locust corner to a 12 acre Lot heretofore bought by said Logan of said Jaley Hubbard thence with Logans line S2¼°W 20 poles to a stake or stone on the point of a ridge thence N87½E 43 poles to a stake or old root in a hollow thence N7°W 21½ poles to a stake another corner of the said 12 acre lott on the hollow afsd. thence with the line of the same S84¾W 40 poles to the Beginning. To have and to hold the same with the appurtanances to him the said Hugh Logan his heirs and assigns forever and the said Moses and Jaley do further covenant that the said Jaley is seized of an undefeasable fee simple title to the said land and empowered to sell the same and further for themselves their heirs and Exors &c the covenant the title to said land to said Logan his heirs and assigns forever against all claim or claimes whatsoever to warrent and forever defend by these presents.
