Transcription of Will of Benjamin Irvine, Dated 8/25/1831 Will probated 5/7/1832; @ Madison Co., Kentucky Will Book E. pg. 267. In the name of God amen. I Benjamin Irvine of the County of Madison and State of Kentucky, being in my usual state of mind and health of body make this my last will and testament viz. I leave to my wife Sarah Irvine one third of the tract of land I now live on during her life and to include the dwelling house barn and all the other guildings with the orchard and wood sufficient for fire,... .. as near to the house as posible. I bequeath to her my negor man Sam during her life to use as her own. I bequeath to her all my house hold and kitchen furnature, bedding clothing and her choice of one third of my books. As to my son James B. Irvine it is unknown to me whether he is dead or alive, but in either event I leave him five hundred dollars which he has ... already ... and free him from all liability to my other heirs. I will and bequeath to my daughter Sophia Dunn my negro man Sam at her mothers death and I bequeath to her nine hundred and five dollars which she has received already in money and property and free her from all further liability to my other heirs. I bequeath to my son Benjamin Fielding Irvine fourteen hundred & ... dollars which he has already received and hereby free him from all liability to my other heirs. I bequeath to my daughter Sarah Dunn six hundred and seventy five dollars which she has received heretofore. I also bequeath to her two thirds of my tract of land where I now reside containing in all about 173 acres and the other one third at my wifes decease. I further declare it to be my wish that after my decease should my wife think proper she may give up the land to my daughter Sally and her husband by their giving bond and approved security to pay her my wife eighty dollars per anum and she may give up Sam to my daughter Sophia Dunn and her husband Nathaniel Dunn by their giving bond and approved security to pay to her my wife Sarah Forty dollars per anum and in case . .. both should refuse to comply as above she my wife is at liberty to rent the land and to hire out said negro Sam just as she may chose.
