From: KyArchives [archives@genrecords.org] Sent: Sunday, November 23, 2008 5:20 PM To: Ky-Footsteps Subject: Jackson.Beckley.1859.Hopkins-Webster-Christian.WILL Beckley Jackson December 12, 1859 Hopkins-Webster-Christian County KyArchives Will Source: Will Book ___ Pg. 86 & 87, Hopkins County, Kentucky Written: December 12, 1859 Recorded: January 2, 1860 Beckley Jackson's Last Will and Testament Will Book ___ Pg. 86 & 87, Hopkins County, Kentucky In the name of God Amen I Beckly Jackson of the county of Hopkins and state of Kentucky feeling the infirmities of age creeping upon me and knowing the uncertainty of death but still of a sound mind and disposing memory do make my last will and Testament revoking all others made or claiming by me to be made in which I do give bequeath and otherwise dispose of all my real and personal estate including cash and cash notes and all other evidences of material property in the manner and under the conditions following to wit. Item 1 First It is my will first of all after defraying my burial expences that all my lawful and just debts shall be paid out of any ready cash on hand or from the proceeds of the sale of my estate. Item 2 It is my will and desire that my sons John Washington Jackson Thomas Jefferson Jackson and Matthew James Jackson each of whom is indebted to me by note for money loaned them shall each one of them have their notes and all other evidences of indebtedness to me now in my prossession returned to them fully ennumerted and cancelled by this my bequest and I forbid my executor to claim and hereby instruct him not to receive from either of my sons above named either in part or whole the money or dues called for by their said notes but to return in their prossession their said notes or destory them in the presence of witnesses immediately upon my death. Item 3 it is my will that no account shall be made by my executor against any of my childred for property or assistance received from me at any time and that no demands shall be made in law or equity for a return of property or money loaned them by me during my natural life and I will be hereby constitute their tilles perfect to the same. Item 4 It is my will and desire that all my children living or the natural heir representatives of a child or children deceased shall be equal each with each other in claim title and division and prossession of the proceeds of the sale of my property and estate as herein after set forth and specified without bar of affects as guarded and particularly stated in Item second (2) and third (3). Item 5 I desire and it is my will that all my land and negros towit Edmund Nelson Oregon Edd Emily Hannah and Lett together with all my personal goods and chattles of Whatsoever kind shall be sold at public vendue to the highest bidder on twelve months time bearing interest from date of sale be giving bond with good security and that the entire proceeds shall be divided equally among all my children as stated in Item fourth. Item 6 Should any item or pieces of property to me belonging or that may come to me by natural or legal procession before this will shall have recorded upon be omitted and not recorded in a codicil amended it is my will that said property shall be disposed of as directed in Item (5) fifth of this my will and all notes and accounts to be collected and proceeds divided. Item 7 I do hereby nominate appoint and constitute as executor of my last will and Testament my son Thomas Jefferson Jackson and having confidence in his integrity his business habits and his fraternal profity and affection it is my is my will and request that he will actfor me and faithfully execute all my will writtiant giving security for his fidelity I witness that this is my will I do hereby sign my name affix my seal and deliver this instrument in presence of Dec 12, 1859 (witnesses) Beckly Jackson W.L. Jenkins Vincent Tapp addenda I Beckly Jackson having first finished my will which I had made after mature reflection and a sincere desire to subscrive the best interests of all my children and having sealed the same I still desire to add the following item as my earnest protest against litegations that too often follows the best executett wills transsiering thereby the honest earning of the honest Testator from his to the pockets of Lawyers viz Item I wish my witnesses to bear in mind and remember that if any child or grand child shall break or attempt to break this my last will and Testament said child or grand child so interfering with my business shall not be evnridered in this will or my heir but shall be cut off from all interest to be in my said estate named and directed to be disposed of in my will Witnesses my hand and seal this day and year above written Beckly Jackson W.L. Jenkins and Vincent Tapp subscribing witnesses to each and the said will and codicil were ordered to be recorded whereupon said will and codicil and this certificate are duly recorded in my office.
