I Horatio Johnson of Fayette County Kentuckky, do make and publish this my last Will and Testament. First it is my will and desire that my Two Sisters Sarah Johnson and Nancy Johnson shall have one Hundred Acres of the Tract of Land on which I reside, to be laid off so as to include the dwelling house and the improvements on said tract, and to be laid off in good form including a Sufficient quantity of Timber, the dwelling house I allude to it the one in which I reside and which I have lately built. It is also my will and desire that my Two Sisters Sarah and Nancy have each, Six Hundred dollars in money out of my Estate. I have in my hands a Legacy of Three Hundred dollars that belongs to my Sister Nancy that was left her by her father -- I have had the use of it about Nine years, and I therefore direct the payment of said sum of Three hundred dollars with Interest thereon for Nine years to the said Nancy -- I also owe to my Sister Sarah Two hundred and Ten dollars and Interest thereon for Nine years past which I also direct to be paid to her said sum being made up of Sixty Dollars which my Father owed her for money she loaned him and one hundred and fifty Dollars of my Father's estate which was still due to her in my hands -- It is also my will and desire that my said Two Sisters Sarah and Nancy shall have the whole of my household and Kitchen furniture including beds bedding and furniture of every description whatsoever that belongs either to the house or kitchen -- I also give my Said two Sisters Three Milk cows now on my place I have also six head of horses that is four mares and two horses which are now in the hands of James & Josiah Downing who are to keep them until the 1st of June next, and who are then to sell said horses with the increase and the proceeds arising from said Sale are to be paid over to my said Two Sisters Nancy and Sarah it being my wish that they should have it. I have also leased to the said Downings a farm for four years at the yearly rent of Two hundred dollars which rent I also direct to be paid over to my said Two Sisters for their own use. I have three Slaves named Ann Mary and David that it is my intention to emapncipate at the following periods and until said periods arrive they are to belong to and Serve my said Sisters Nancy and Sarah. The said Ann is to be free at the end of Eight years from this time, Mary is to be free at the end of Ten years from this time & David is to be free at the end of Twelve years from this time -- And if said Ann or Mary should have any child or children before said periods arrive, their children if they have any are to be free at the same periods that their Mothers are entitled to their freedom. I have also a Negro Woman named Milley she is hired out during the year 1835 at the expiration of which time I hereby emancipate and set her free -- I have also a black man named Stephen hired out during this year, at the end thereof, I also emancipate and set him free -- It is my will and desire that the sum of Three hundred Dollars of my estate be appropriated to the building of a Stone fence around the family grave yard being the place where my Father and Mother are buried -- and the balance of said Sum after the completion of the said fence is to be applied to the purchase and erection of Tombstones. After the foregoing legacies are paid, together with said Three hundred dollars to the family grave yard, and the said debts together with any other in this will, be equally divided amongst: ABSTRACTION BEGINS: "all sisters and brother; "two children of my sister Rachel Alnutt, dec'd; "sell 100 acres now leased to Downing at public auction, proceeds to be paid: "$500 to brother Amos; $800 to Elder W. Conrad of Grant County for use/benefit of sister, Elizabeth McGinnis" w/o Thos. McGinnis; Eliz. McGinnis' portion to be placed in trust NOT in control of her husband, remaining to her surviving chn. at her death; proceeds from sale of "McNairy land" divided amng Nancy, Polly & chn of dec'd sister Rachel; 100 acres of land in fourths: Elizabeth, Polly, Amos & two chn. of Rachel to share her one fourth; Any person attempting to take away via will challenge devises and bequests of land to sisters Sarah and Nancy will be enalized by cancellation of their own bequests/devises.
