I William JOHNSON of the County of Nelson and State of Kentucky being in a low state of health but sound in mind and memory and calling to mind that we are all mortal do make and ordain this my last will and testament, that is to say principally and first of all I recommend my soul unto the hand of Almighty God that gave it and my body I recommend to the earth from whence it cane and as touching such worldly estate whence with it has pleased God to bless me with in this life I give devise and dispose of the same in the following form manner VIZ First I gave and bequeath to my son in law William MONTGOMERY seven hundred and seventy two dollars and thirty two cents and to my son in law Francis CUNNINGHAM I gave two hundred dollars and to my son in law Thomas MONTGOMERY I gave six hundred and seventy two dollars and thirty two and half cents and I gave to my son John JOHNSTON one dollar . I gave to my son Robert JOHNSTON four hundred dollars and I gave to my grandson William Montgomerys son Robert one hundred dollars and I gave to my daughter Janet CUNNINGHAMS children six hundred and seventy two dollars and thirty three cents to be divided as follows. towit and first I gave to Robert CUNNINGHAM ten dollars and I gave to Polly CRATHERS ninety one dollars and sixty nine cents and I gave to Peggy HILL ninety one dollars and sixty nine cents and I gave to Janet CUNNINGHAM ninety one dollars and sixty nine cents and I gave to Nancy CUNNINGHAM ninety one dollars and sixty nine cents and I gave to Rebecca CUNNINGHAM one hundred and one dollars and I gave Sally CUNNINGHAM one hundred and one dollars and I gave to my grandson Johnson MONTGOMERY son to William MONTGOMERY my horse and saddle and saddle Bags and bridle and gave to my grandson Thomas MONTGOMERY son to Thomas MONTGOMERY my large Bible and I gave to William NIELL my book called Edwards history of Redemption and four dollars and I gave to John BOYL my book called the Afflicted m any companion and I gave to my daughter Polly MONTGOMERY two pair of blankets and I gave to my daughter Nancy MONTGOMERY one sheet and a quilt and I gave to my grand daughter Polly MONTGOMERY daughter to Thomas MONTGOMERY my trunk and my body clothes to be sold and divided between William MONTGOMERY, Thomas MONTGOMERY and Francis CUNNINGHAM and if there is any more of my property let it be divided between William MONTGOMERY, Francis CUNNINGHAM and Thomas MONTGOMERY and William NIELL and I do hereby utterly revoke and disannul all and any other former Testament wills Legacies bequeaths and _____ by me in any wise mentioned willed and bequeathed ratifying and confirming this and no other to be my last will and testament. in witness whereof I have hereunto set my hand and seal this Sixth day of September Eighteen hundred and thirteen Signed Sealed and delivered in presence of William JOHNSON [seal] Ann JENNINGS John HAGERMAN William NIELL At a County Court held for Nelson County in Kentucky on Monday the 20th day of December in the year of our Lord eighteen hundred 1813 the above last will and Testament of William JOHNSTON deceased was proved by the Oath of John HAGERMAN one of the subscribing witnesses thereto and ordered to be certified and at a County Court held as aforesaid on Monday the 17th day of January in the year 1814 on the motion of William NULL and Thomas MONTGOMERY executors of William JOHNSTON deceased it is ordered that a commission issue as the Law directs to take the deposition of Ann JENNINGS a subscribing witness to the last will and Testament of the said deceased. Teste Ben GRAYSON clerk of the Court The Commonwealth of Kentucky to Dawson BLACKMORE ___ chief magistrate of Madison or of Jefferson County in which the witness a subscribing witness to the annexed will resides and in the Indiana Territory Greetings Know you that we trusting to your fidelity and provident circumspection in diligently examining taking and certifying the attestation of the said Ann JENNINGS to appear before you and her examine upon her oath or affirmation whether William ( Signed and published the said will or writing as his last will) JOHNSON the Testator in the annexed will and Testament or whether some other person signed it by his direction and whether the said Testator was of disposing mind and memory at that time and whether the said Ann JENNINGS subscribed her name thereto in his presence and at his request and her examination is to our County Court of said County of Nelson that you may certify and send enclosed returning also to us this writ with the annexed will or writing without delay. Greetings Know ye that agreeable to a commission to us directed by order of the said honorable Court to take the deposition of Ann JENNINGS this 7th day of February in the year 1814 at my house personally appeared before me and being duly sworn deposeth and saith that on the seventh day of September in the year 1813 the said Ann JENNINGS saw the within _____ Testator William JOHNSTON sign his name to the will annexed and deliver the same as his last will and Testament and that the said Testater William JOHNSON as she verily believes was of sound mind and disposing memory at the time he subscribed the said will and that the said Ann Jennings subscribed her name thereto in his presence and further this witness saith not Given under my hand and seal this 7th day of February in the year 1814.
