Deed Bk C, p 57, 58 KINNEY; DUFNER; TUFNER: PHILLIPS; DOUGHERTY; SPEED [NOTE, in the body of the indenture, the name is Jacob DUFNER, yet he signed it TUFNER] This Indenture made this seventeenth day of May one thousand eight hundred and foure Between John KINNEY of the County of Morris & State of New Jersey of the one part, and Jacob DUFNER of the County of Washington State of Kentucky of the other part, Witnesseth that the said John KINNEY for and in consideration of the sum of six hundred and sixty dollars to him in hand paid by the said Jacob DUFNER the receipt whereof is hereby acknowledged, hath granted bargained and sold, and by these presents doth give grant bargain and sell unto the said Jacob DUFNER and to his heirs and assigns forever, all that tract or lot of Land together with the improvements laying and being situate in Hardin County in the State of Kentucky afford and on the South Side of the Roling fork of Salt River containing two hundred and twenty acres be the same more or less, being located upon a Military Warrant in the name of John PHILLIPS on 23rd of June one thousand seven hundred and eighty and surveyed twenty fourth day of Octobert seventeen hundred and ninety five, and bounded as follows to wit Begining at a large Elm, Hoop ash and buckeye, on the south bank of said fork running thence down the said fork with the different meanders thereof two hundred and two poles to two Beaches, Spanish oake and hickory on a high bank of the said fork thence south forty two degrees west one hundred and seventy five poles to two Hickorys and white oaks, thence South forty six degrees east one hundred and wighty poles to three small hickory and a Black oak, thence North forty four degrees, East passing through DOUGHERTYS old place station two hundred and two poles to the begining containing and to contain two hundred and twenty acres more or less together with all the appurtenances thereunto belonging and also all the right title Inderest claim and demand whatsoever of the said John KINNEY in and to all and singular the above and within granted premises unto him the said Jacob DUFMAN his heirs and assigns to his and their own proper use forever will warrant and defend against all persons whatsoever claiming the same either in law or equity. In Witness whereof the said John KINNEY hath hereunto set my hand and seal the day and year above written. Witnesses Present Jn KINNEY [seal] Richard PEAKE William [X] BOWLES John [X] BOWLES Whereas by the mode land is granted in Kentucky disputes frequently arise as to titles, and in case it should so happen with the above granted land and any part or the whole should be lost to due corse of law or in equity, it is hereby expressly understood by the parties that the said KINNEY is only to refund three dollars per acre in case any is lost, that being the price said TUFNER paid for the land notwithstanding the Deed is a general warrantee John KINNEY Jacob TUFNER Nelson Circuit Sct I, Thomas SPEED, Clerk of the Nelson Circuit Court do hereby certify that the within Indenture was this day acknowledged before me in my office by the within named John KINNEY to be his act and deed and that a true copy of the within Deed is truly recorded in my said office. In Testimony whereof I have hereunto set my hand this 10th day of August 1804 Tho SPEED Hardin County Sct I Benjamin HELM Clerk of the County Court of the County aforesaid, do certify that the foregoing and within Indenture of bargain & sale from John KINNEY to Jacob DUFNER together with the certificate thereon indorsed accompanying and authenticating the same was presented to me in my office the 28th day of May 1805.
