Deed Bk P, p48, 49 PHELPS; LAMPTON; PRATT; SIMMONS; MOORE; MYERS; SAMUELS; STONER This Indenture made and entered into this 18th day of March 1861 by and between Westley PHELPS Sheriff of Bullitt County of the first part and Robt. N. LAMPTON of Jefferson County Ky of the second part. Witnesseith That whereas the said party of the first part has by writing or two writs of Condition Esfromas [?] issued from the Bullitt Circuit Court one in the name of Bernard S. PRATT and the other in the name of N. SIMMONS assee against said MOORE, sold the interest of W. C. MOORE of in ___ a tract of one hundred & Seventy Seven and one half acres of land, situate, lying and being in the County of Bullitt being the same land owned formerly by said W. C. MOORE, as Heir of his father, the other two thirds was conveyed to him by his two sisters. Reference to said deeds will more particularly shew and the same land mortaged by W. C. MOORE to Henry MYERS, reference is had to said mortgage of record in the Bullitt County Court, said land was sold by Sheriff subject to the Mortgage of Henry MEYERS, before refered to and he only conveys the title subject to said Mortgage. The party of the second bidding at the sale the sum of Five hundred & seventy Six Dollars 99/100 amount of the Mortgage debt to MYERS and the two Executions above referred to and he has paid in cash this day, Three Hundred and Fifty Dollars to N. SIMMONS for which the Mortgage to MYERS was made, MYERS being MOORES security for said debt, and executed his note payable in three months to N. SIMMONS for Thirty four Dollars 68/100 being the amount in full due to SIMMONS from exons and from the debt for which the MORTGAGE was executed for the balance of said amt the said party of the second part has this day executed a Bond, as by law required to Bernard S. PRATT one of the Plaintiffs in the Executions, under which the land was sold, a bond with A. LAMPTON, security, for One hundred & Ninety two Dollars _____ five cents, the amount of said PRATTS debt, the sum above ______ constituting the amount bid by said LAMPTON for said Westley PHELPS party of the first part for the consideration above named do certify ____ -___ unto the said Robert N. LAMPTON his heirs & assigns forever the before described tract of land sold as before set out as fully as by law I am authorized to do without incurring any individual liability or responsibility whatever conveying W. G. MOORES interest on the one hundred & Seventy Seven & one half acres above set _____ In witness whereof the said Westley PHELPS Sheriff as aforesaid has hereunto set his hand & seal the day & year above written Westley PHELPS SBC State of Kentucky Bullitt County Sct I Robt F. SAMUELS clerk of the County Court for the County aforesaid so certify that on the 19th day of March 1861 the foregoing deed was produced to me in my Office and acknowledged by Westley PHELPS Sheriff of Bullitt County to be his act and deed.
