In the first place it is my will and desire that my just debts should be paid. Secondly, I will and bequeath unto my Brother John F. Lewis in trust for the use and benefit of my brother Thomas Jefferson Lewis and my sister Martha Jane Lewis my whole and entire estate real, personal, and mixed. Willing and directing that my Said brother as Trustee shall hold in trust the half of my estate devised to Thomas Jefferson Lewis until he arrives at the age of twenty- one years without my said trustee being in any way bound to render any account to said Thomas Jefferson of the profits or proceeds thereof at which time upon the arrival of my said brother at twenty one years of age it is my will and desire that said Trustee shall pay over to him his said half of my estate. But it is my further will that if my said Trustee John L Lewis in whose discretion I have confidence should think it proper and necessary so to do that he may advance to the said Thomas Jefferson a portion of the estate hereby bequeathed even previous to his arrival at age of twenty one years. It is my will and desire that the said John F Lewis shall hold the half of my estate hereby devised to him in trust for my sister Martha Jane Washington Lewis free of charge and without any account of the proceeds or profits thereof until the arrival of my said sister of the age of sixteen years from which time I will that my said sister shall be paid and receive the profits of said Trust estate until my said brother shall think proper to pay over to her the principle which I leave discretionary with my said Trustee. But I hereby vest my said trustee with power to advance to my said sister at any time a portion of the estate hereby bequeathed in trust for her if he my said Trustee shall think it necessary and prudent so to do. It is my further will and desire that if either or both of my above devisees that is Thomas Jefferson Lewis and Jane Washington Lewis shall die before they shall have received the estate hereby bequeathed to them that then one portion of his other so dying shall be paid over to my brothers Jesse P Lewis and David B. F. Lewis but not until one period shall have arrived at which my said first named devises would be entitled to receive the same under this will as it is my desire that in no event my brother John F. Lewis shall be compelled to pay over said estate sooner than the period aforesaid. It is my will and desire that my Brother John F. Lewis shall if he thinks proper take my interest in our stock of goods now upon hand at cost. This is provided that he may if he thinks proper continue said mercantile establishment without being compelled to divide the goods or sell the same at auction. It is my further will and desire that my brother John F. Lewis shall sell and convey my land in estate or real estate and thus convert the same into money at any period of time he may think advisable. I hereby appoint my said Brother John F. Lewis Executor of this my last will and testament and request that he be permitted to qualify as such without giving any security, I having full confidence in his integrity and good management of my affairs. The foregoing Instrument of writing purporting to be the last will and testament of James H. Lewis dec’d was produced in Court and proven by the oaths of Juliet Lewis one of the witnesses hereto and further time given for full proof of the same. And afterwards at a County Court began for the County of Woodford on Monday the 3rd day of December 1832 an Instrument of writing purporting to be the last will and testament of James H. Lewis dec’d over again produced in Court and further fully proven by the oath of James E. Robinson a witness thereto proven to record. Whereupon John T. Lewis the executor therein named came into court and took the oath required by law (Bond with Security) being dispensed with by the will. Lettes Testamentary is granted him. John McKinney.
