Mattingly, a resident citizen of Marion County, Kentucky, being of sound mind and memory, do make and publish this as my last will and testament. ITEM 1: I want all my just debts paid as soon after my death as practicable. ITEM 11: I hereby give and bequeath the sum of $25.00 to the Pastor of the Roman Catholic Church at St. Mary's Ky., called St. Charles Church, this sum to be used as an offering in the saying of masses for the repose of my soul: I also give and bequeath the sum of $25.00 to the Pastor of the Roman Catholic Church at St. Mary's, Ky., called St. Charles Church, the sum to be used as an offering in the saying of masses for the repose of the souls of my deceased wives, Annie Mary Mattingly, and Sallie Catherine Mattingly. ITEM 111: The balance of my estate, real, personal and mixed, wherever situated I hereby give, devise and bequeath to all my children, Sallie C. Mattingly, Ida Mary Alvey, Thomas Kendrick Mattingly, Wallace Leo Mattingly, and J. Bernard Mattingly, same to be divided among my aforesaid children share and share alike. It is my desire that my farm shall not be sold until my youngest child reaches the age of twenty one years, but if my Executor hereinafter named, should deem it to be the best interest of my estate that said farm should be sold at an earlier date, my said Executor shall have the right to do so. ITEM IV: I hereby authorize and direct my Executor to sell said farm, as above indicated, for the purpose of distributing the proceeds thereof among my children as set out in paragraph 111 herein, and when sold my said Executor to make to the purchaser thereof, a general warranty deed for same. ITEM V: I hereby nominate, constitute and appoint my friend, S. B. Bottom, of Lebanon, Ky., Executor of this, my last will and testament. Given under my hand this 7th day of April 1915. We, the undersigned state that C. B. Mattingly, in our presence, signed and acknowledged the foregoing paper as his last will and testament, and we, as witnesses, sign this paper in his presence and in the presence of each other. At a regular term of the Marion County Court, held in and for said County in the State of Kentucky, on the 4th day of October 1915, the for going paper purporting to be the last will and testament of C. B. Mattingly, deceased, was produced in open Court and the last will and testament of C. B. Mattingly, deceased, was proven by the oaths of C. C. Boldrick and J. LaMotte Spalding, the two attesting witnesses thereto to be the last will and testament of C. B. Mattingly, deceased, And same was ordered to record as the last will and testament of C. B. This is the recorded copy of the will. As such, the signature of C. B. Mattingly is not on this copy. Certainly, it was on the original copy of the will.
