From: KyArchives [Archives@genrecords.org] Sent: Wednesday, October 27, 2004 7:09 PM To: Ky-Footsteps Subject: McGinnis-to-Caldwell.1810.Mercer.DEED George Caldwell - Samuel McGinnis November 1 1810 Mercer County KyArchives Deed Written: November 1 1810 Recorded: August 16 1810 Deed Book 7, page 474 Know all men by these presents that I Samuel McGinnis of the County of Mercer and State of Kentucky hath this day for my self my Heirs &c Bargained & Sold aliend and confirmed & by these presents doth bargain sell alien and confirm unto George Caldwell Sen'r of the County and State aforesaid a certain Tract or parcel of Land lying & being in Mercer County on the waters of Chaplines fork containing three Hundred and nine Acres being the tract on which I now live including three Small tracts adjoining of it which I purchased at different times To have and to hold the said Tract or parcel of land with its appurtenences to the only proper use and behoof of him the said George Caldwell & his heirs forever and the said Samuel McGinnis doth further covenant and agree to warrant & forever defend the said land and premises against the claim or claims of him and his Heirs and all and every other persons whatsoever in any way claiming the same. But this Sale and conveyance is subject however to the following conditions and limitations (viz) that whereas the Sd. Samuel McGinnis did on this day execute his note of hand to the said George Coldwell for one Thousand and eighty dollars payable on the first day of november 1812 & four hundred Dollars of which to bear Interest from the date & and the said Samuel McGinnis being desireous [sic] to secure the payment of the said Sum to the said George Caldwell his Heirs &c have been induced to enter into this Deed of trust on conditional concequences [sic] now it is the clear understanding and agreement of the parties thereto that if the said Sum of money with Interest as Stipulated is paid to the said George Caldwell by the said Sam'l McGinnis or any person for himself ["self" crossed out] on or before the time specifyed then this indenture [crossed out] instrument of writing to be void and of no effect and to be delivered up to be cancelled but should it so happen but the said sum of money should not be paid at the time appointed with Interest as mentioned then the said George Caldwell is hereby authorised and empowered to Sell the Sd. land or so much thereof as will pay and discharge the said debt & Interest as stipulated.
