From: KyArchives [Archives@genrecords.org] Sent: Wednesday, October 27, 2004 10:35 PM To: Ky-Footsteps Subject: McGinnis-to-Lillard.1815.Mercer.DEED James Lillard - Samuel McGinnis September 25 1815 Mercer County KyArchives Deed Written: September 25 1815 Recorded: September 25 1816 Deed Book 9, page 522 This indenture made this 25th day of September 1815 Between Samuel McGinnis of Mercer County and State of Kentucky of the one part and James Lillard of the same County and State of the other part Witnesseth that for and in consideration of the sum of one dollar by said Lillard to said McGinnis in hand paid the Receipt whereof is hereby acknowledged Has bargained and Sold unto said James Lillard a certain tract or parcel of land in Mercer County on the waters of Chapline containing one hundred acres it being the tract of land purchased by said McGinnis of Amos Thornsburg and deeded to said McGinnis by Jeremiah Briscoe with its appurtenances to have and to hold the said tract or parcel of land with its appurtenances unto the said James Lillard and his heirs and assigns forever the said McGinnis will forever warrant defend against the claim or claims of all and every persons whatsoever. But it is clearly understood between the parties that whereas the said James Lillard has entered himself as security for said McGinnis in two Bounds (Viz) an appeal bond to Charles Hart in the penalty of eight hundred dollars under a ????? of the Mercer Circuit Court rendered at the September term 1815 and an Injunction Bond to George Caldwell's executors in the penalty of one Hundred and fifty dollars to enjoin Seventy five dollars of a Judgement rendered by the Mercer Circuit court at the September term 1815 now if said McGinnis shall keep said Lillard clear from all responsibilities to said Caldwell's Executors and said Hart on the Bond aforesaid then this Indenture is to be null & void But in case said Lillard may have to pay any money on account of said securityship then it is to reman in full force and virtue. In testimony whereof the said McGinnis has hereunto set his hand and affixed his seal the date above. Samuel McGinnis (Seal) Executed in presence of John J. Allin D.C. Mercer County Sct.
