From: KyArchives [Archives@genrecords.org] Sent: Wednesday, October 27, 2004 8:15 PM To: Ky-Footsteps Subject: McGinnis-to-Smith.1810.Mercer.DEED Jesse Smith - Samuel McGinnis November 5 1810 Mercer County KyArchives Deed Written: November 5 1810 Recorded: November 1810 Deed Book 7, page 514 This Indenture made this 5th day of November in the year of our lord one thousand eight hundred & ten between Samuel McGinnis & wife on the one part and Jesse Smith on the other part witnesseth [crossed out] both of the County of Mercer and of Kentucky Witnesseth That whereas the said Samuel McGinnis Sold to George Caldwell of the County and state aforesaid Fifty acres of land lying in said County on Wilsons run and bounded as hereafter mentioned and the said Caldwell on the day of [blank] sold the said land to the said Jesse Smith Now for & in Consideration of three hundred Dollars paid by the said Caldwell to the said McGinnis the receipt whereof is hereby acknowledged and for the further sum of five Shillings paid by the said Smith to the said McGinnis the receipt whereof is hereby [crossed out] also acknowledged [the phrase "and for....also acknowledged" was repeated and then crossed out] and in consideration of four hundred and twenty five dollars paid by the said Smith to the said Caldwell the said McGinnis doth by the presents and at the request and Special direction of the said Caldwell bargain Sell alien and confirm by these presents the said fifty acres of land lying as aforesaid and bounded as follows (to wit) Beginning at a point in the middle of said Wilsons run eleven poles below the mouth of William McDowels Spring branch in the south boundary line of said McDowell, ass'ee of John Bowmans thousand acres Survey, thence South eighty seven degrees West with a line of said thousand acre Survey Sixty three and one half poles to a mulberry Stump, thence South Sixteen degrees West one hundred and eleven poles to a white oak and Sugar tree on the north west side of said run a corner to William Starling at high water mark thence down the run and bending on its meanders South thirty five degrees East twenty six poles north thirty six east Seventy poles South thrty five east eleven poles to a white ash and walnut tree corner to Joseph McDowell on the south east side of said run vary[?] little above the mouth of said Joseph McDowells spring branch thence crossing the run and running across a bend of the same north thirty two degrees east sixty eight poles to the edge of low water mark in said run thence down the run North eight degrees west twenty six poles north thirty five degrees East thirty two and one half poles North one degree west thirty one poles to the Beginning with its appurtenences To have and to hold the said tract of parcel of land with its appurtenences to the said Jesse Smith and his Heirs forever and the said Samuel McGinnis and Mary his wife by these said [crossed out] presents doth covenant and agree to and with the said Jesse Smith and his heirs forever that he the said Sam'l McGinnis & Mary his wife will forever save the said Jesse Smith harmless in the peaceable possession of the before mentioned premises and the said Samuel McGinnis and [blank] his wife has and by these presents for himself his Heirs Executors & Administrators to the said Jesse Smith and his heirs forever that he will forever warrant and defend the right and title to the above mentioned tract of land against the Claim or Claims of all and every person or persons whatsoever. Atteste Tho. Allin C.C. [in the margin] Relinquishment of Dower Recor'd B 8th p 82 Deed Book 8, page 83 [not 82] Mercer County Sct. This Day Polly McGinnis wife of Samuel McGinnis a party to the within Deed personally appeared before us Archibald Bilbo & James Caldwell two of the Commonwealth Justices of the peace for said County and relinquished her right of Dower to the within mentioned tract of land as the law directs & consented that the same may be entered of Record Given under our hands and seals this 1st day of August 1811.
