Wingate - Et al McGinnis March 19 1878 Boyle County KyArchives Deed Written: March 19 1878 Recorded: April 10 1878 Book 14, page 478 This Indenture, Witnesseth, That whereas upon proper proceedings had in the Boyle Circuit Court in the case therein pending of John B. McGinnis' Administrators & others against John B. McGinnis' heirs a judgment was rendered by said court at its Sept term 1875 ordering the sale of the tract of land hereinafter described and directing the Master Commissioner of said court to make said sale and an order was entered at the March term 1876 of said court, ordering a sale of said land in accordance with the directions of said judgment of the Sept Term 1875, and whereas the Master Commissioner of said court, did on the 17th day of April 1876, (after advertising the same ["same" crossed out] sale of said land as required by said judgment, and said day being the first day of the April term 1876, of the Boyle County Court) expose said land at public sale before the Court House door in the town of Danville Ky, and at which sale A. T. Wingate being the highest and best bidder became the purchaser thereof for and at the price of Eighteen hundred dollars, and executed his bonds as required by said judgment, and the Commissioner having made and filed in said case his written report of sale aforesaid at its Sept term 1876 and at which term the report was approved and the said sale ratified and confirmed and receiver appointed to collect said bonds, having filed his report at the March Term 1878 of said court showing that the purchase money of said land has been fully paid, and at said March Term 1878 the undersigned having been appointed by said court its Special Commissioner to make to said [blank space] Wingate a deed to said land for and on behalf of Lemuel O. Broyles, Sarah E. Broyles, Samuel W. Broyles, Fayette Broyles, and Maggie Lou Bonta plaintiffs in said case and the only heirs at law of John B. McGinnis dec'd (and for greater certainty reference is made to the proceedings in said case) Now for and in consideration of the premises said Lemuel O. Broyles, Sarah E. Broyles, Samuel W. Broyles, Fayette M. Broyles and Maggie Lou Bonta by D. T. Fackler as Special Commissioner as aforesaid have bargained and sold and by these presents do bargain sell alien and convey unto said A. T. Wingate a certain tract or parcel of land (same directed to be conveyed as aforesaid) lying and being in Boyle County in the state of Kentucky, on the waters of Chaplin, and described as follows: Beginning at a stone in Tevis line corner to the portion allotted to Mrs. Sarah E. McGinnis wife of John B. McGinnis for dower, thence S89-1/2E 16- 40/100 poles to white oak corner to said Tevis thence S1/2W 9-12/100 poles to a stone corner to O'Neill, thence N89-1/2E 51-52/100 poles to a stone corner to O'Neill, thence S86-1/2E 40 poles to the centre of Chaplin, thence N18-1/2E 79- 72/100 poles to a point in centre of same corner to Thomas Crawford thence N89- 1/2W 6 poles to the place of an oak stump in Stewarts old line, thence N16-1/2E 27 poles to a stake, thence N19-1/2W 27 poles to a stake thence N31-1/2W 27- 60/100 poles to a stake thence N59-1/2W 53-20/100 poles to two white oaks corner to Philip Beard thence N29-1/2W 20-50/100 poles to a stone corner to same thence N79-1/2W 16-68/100 poles to a stone corner to said dower thence S2W 209-72/100 poles to the beginning, containing one hundred and nine acres and two roods to have and to hold unto said A. Chrisman Clerk Boyle Circuit Court do certify that this Deed from John B. McGinnis Hrs by D. T. Fackler Special Com'r to A.T. Wingate was on the 19th day of March 1878 presented in open court by said com'r and was by him duly acknowledged to be his act and deed, and the said deed having been examined by the court was approved and confirmed and so endorsed by the judge, and ordered to be transmitted duly certified to the Clerk of the Boyle County Court for record, which is now done.
