Phillips, Wm. D. McGinnis, W. L. Tarkington Guardian for Susan J. McGinnis vs. Rebecca A. McGinnis, for a Division and Partition of the Lands descended to them from William McGinnis, deceased, Said Petition file July 19, 1858, and whereas Commissioners appointed by the Boyle County Court have divided said Land, and said Division having been ratified and approved by said Court, and whereas Wm. D. McGinnis desires the portion allotted to him to be conveyed to James M. Phillips & wife; and whereas at the October Term 1858 of said Court the undersigned was appointed a Commissioner to make a Deed of Partition for their respective interests in said Land - Now, for and in consideration of the above premises, I, Jas. F. Zimmerman, Commissioner aforesaid, for and on the part of Susan J. McGinnis, and Rebecca A. McGinnis, and Wm. D. McGinnis, convey to James M. Phillips and Lucinda Phillips, his wife, Lots Nos. 1 & 2 in said Division, bounded as follows: Beginning at a stone corner to Geo. M. Proctor, in Thos. Coulter's line, thence 89.50E 138 poles to a stone corner to Wm. Owens, at B. thence N1/2E 18-56/100 poles to a stone at figure 2, thence with the line of No. 3 S89.50W 138 poles to a stone corner to lot No. 3 thence S1/2E 18-56/100 poles, to the beginning- containing 16 acres. --- And also for and on behalf of James M. Phillips & Lucinda Phillips, his wife, William D. McGinnis and Susan J. McGinnis, conveys to Rebecca A. McGinnis, Lot No 3 in said Division, bounded as follows: Beginning at a stone corner to Lot No 2, thence with Wm. Owens line N1/2E 10-14/100 poles to a stone corner to Lot No. 4, thence with said line S89.50W 138 poles to a stone corner to Same, thence S1/2E 10-14/100 poles to a stone corner to the above Lot conveyed to Phillips & wife, thence 89.50E 138 poles to a Stone corner in Owen's line to the beginning - containi ng8-34acres.Andthe said Commissioner, for and on behalf of James M. Phillips and Lucinda Phillips, his wife, Wm. D. McGinnis and Rebecca A. McGinnis, conveys to Susan J. McGinnis Lot No 4 in said Division, bounded as follows: Beginning at a Stone corner to Lot No. 3, thence N1/2E 9-56/100 poles to a stone corner to the Widow's Dower, thence with her line S89.50W 138 poles to a stone corner to same, thence S1/2E 9-56/100 poles to a stone corner to Lot No 3, thence with said line N89.50E 138 poles to the beginning - c ontaining8-14acres. And the said parties above, by Jas. F. Zimmerman, Commissioner, will forever warrant and defend to and from each other the respective lots hereby conveyed free from the claims of all person whatosever. In testimony whereof, I, Jas. F. Zimmerman, Clerk of said Court, do certify that the foregoing Deed of Partition from McGinnis' Heirs by Commissioner, to McGinnis' Heirs, was produced to this Court at its above Term, duly acknowledged by said Commissioner, examined by the court, approved and ordered to be recorded.
