From: KyArchives [Archives@genrecords.org] Sent: Sunday, October 17, 2004 11:28 PM To: Ky-Footsteps Subject: McGinnis.Thomas.1824.Mercer.WILL Thomas McGinnis December 30 1824 Mercer County KyArchives Will Source: Will Book 8, Page 28 Written: December 30 1824 Recorded: February 7 1825 In the name of god Amen I Thomas McGinnis of the County of Mercer & State of Kentucky do constitute ordain & declare this instrument to be my last & will and testament revoking all others. first I give & bequeath to wife Nancy McGinnis the whole of my estate real & personal during her natural life or widowhood and at her decease or marriage the whole of my estate to be sold except my Slaves & divided among my Children in the following manner one third part to Ally Noe & her heirs and one third to Nancy Fife & her heirs & one third to Polly Ament & in case that Polly Ament should depart this life without issue her part of my said estate is to be equally divided between my daughters Ally & Nancy and their Heirs. And after the decease of my wife Nancy McGinnis my Negro man Jess is to be emancipated Also my Negro Woman Cassa & her increase is to have he freedom at the same time, & my negro Boy David three years Old the 12th day of December Instint is to have his freedom at the death of my wife & if that event takes place before Sd. David arrives to the age of twenty one years he is to be bound to some good trad until he arrives to such age by the Mercer County Court. And if my wife thinks propper she may at any time during her life or widowhood make sale of any of my personal property without being accountabl for so doing. It is fully my intention that my dughter Polly Ament receive her equal part at the time my othe two Children receive theirs & all her part of my said estate remaining in her possession at her decease to be equally divided between my other Children & their heirs. I do hereby appoint James Caldwell Executor of this my last will & testament in testimony whereof I hereunto set my hand & seal this 30th day of December 1824.
