From: KyArchives [Archives@genrecords.org] Sent: Wednesday, October 27, 2004 11:32 PM To: Ky-Footsteps Subject: McGinnis.William.Estate.1815.Mercer.DEED Michael Broyles - Joel T., Deputy Sheriff Williams August 11 1815 Mercer County KyArchives Deed Written: August 11 1815 Recorded: January 20 1817 Deed Book 10, page 173 Whereas by Virtue of a writ of Fieri facias issued from the Clerks office of the Mercer Circuit Court on the 23rd day of June 1815 and directed to the Sheriff of Mercer County in the name of James Kincaid against the Estate of William McGinnis dec'd in the hand Patsy McGinnis administratrix of [crossed out] unadministered & [word crossed out] the tract of land whereon Said Administratrix then resided of the estate of Patsy McGinnis Thomas McGinnis David McGinnis Greenberry McGinnis Smith McGinnis William McGinnis Margaret McGinnis McGinnis Brazilla McGinnis and Burrilla McGinnis heirs of Sd. Decedent Subject to the Widows dower therein for the Sum of four hundred dollars with interest thereon to be computed after the rate of Six per cent per annum from the 25th day of December 1808 until paid also three hundred dollars [crossed out] and forty dollars with like interest from the first day of September 1809 until paid and the further Sum of five hundred dollars with like interest from the first day of May 1809 until paid for debt and eighteen dollars forty seven cents costs, which writ was returnable to the Second Saturday Succeeding the first monday in September then next ensuing the date thereof And Whereas on the 20th day of July 1815 the Said Writ was delivered to me Joel T. Williams deputy Sheriff for Henry Palmer Sheriff of Mercer County to be executed, and thereupon I levied the Same One hundred and twenty three acres of land it being the Same mentioned in Said Execution and herinafter more fully described, and Sold the Same on the 11th day of August 1815 to Henry May Attorney in fact for the pltff he being the highest bidder at the price of three hundred and fifty dollars, Subject to the encumbrance of the widows dower on a Credit of three months and thereupon the Said Henry May Sold the Same to a Certain Michael Broyles of the other part Witnesseth that for and in consideration of the premises aforesaid and at the request of Henry May I do by these presents Sell and Convey unto the Said Michael Broils the land before mentioned Subject to the Widows dower the Same being in two parcels & adjoining each other the one piece Beginning at a white Oak and beech tree on the east Bank of Chapline in Harbinsons line thence east one hundred and six poles to a Sugartree beech and elm a Corner to a tract patented to James Speed thence South eighty Seven poles to a beech which is also a Corner to land of Henry May thence with Mays line West Seventy poles to a beech, and Iron wood on the Creek thence down with the meanders of the Creek to the Beginning. The other tract Begining at two beeches and a hackberry in Lockmans line thence east twenty four poles to a beech and hickory Corner to Said Lockman thereon South eighty eight degrees east one hundred and twenty Six poles to a beech and Iron wood on the bank of Chapline thence North twenty Seven degrees west one hundred and four poles down the Creek to a Sycamore in Alexander Walker line thence West one hundred poles to a beech in Said line thence South eighty eight poles to the Beginning with its appurtenances to have and to hold the Said tracts of land with their appurtenances unto the Said Michael Broils his heirs & assigns forever to his and their only proper use and behoof To have & to hold forever, I the said Williams Deputy Sheriff as aforesaid will warrant and defend so far as I wold [sic] be bound by law to defend as Deputy Sheriff as aforesaid.
