From: KyArchives [archives@genrecords.org] Sent: Sunday, January 27, 2008 2:57 PM To: Ky-Footsteps Subject: McHolmes-to-Baber.1835.Pulaski.DEED John Baber - John McCaw Holmes September 29, 1835 Pulaski County KyArchives Deed Written: September 29, 1835 Recorded: October 6, 1835 Pulaski County, Kentucky Deed Bk. 8, p 265 - 267 This Indenture made and entered into this 29th day of September, in the year of our Lord, eighteen hundred and thirty five by and between John Mc Holmes and Jerusia his wife of the County of Pulaski in the state of Kentucky of the first part and John Baber of the above named county and State of the second part, Witnesseth that for and in consideration of the sum of four hundred Dollars lawful money of the United States to the said party of the first part in hand paid by the said party of the second part, the receipt whereof they do hereby acknowledge, they the said party of the first part hath granted bargained and sold and by these presents doth grant bargain sell and convey to the said party of the second part the following described tract of Land being and lying in the said county of Pulaski in the state of Kentucky on the waters of Fishing Creek and bounded as follows, to wit, The first Beginning at a Black oak thence South 130 poles to a Sugartree and Beech thence West 158 poles to a Poplar, thence North 108 poles to a Dogwood, & Hickory, thence East 17 1/2 poles to two Dogwoods thence North 38 [degrees] East 94 poles to two Gums in a Swamp, thence East 80 poles to Black-Jack tree, thence South 50 poles to the Beginning containing 145 acres be there more or less. To Have and To Hold the aforesaid Tract or parcel of land with the improvements and appurtenances thereof to him the said Party of the second part, his heirs and asigns forever. And the said John Mc Holmes and Jerusia his wife doth covenant and agree to and with the said John Baber that they will well and truly warrant and defend the aforesaid tract of Land from the claim of themselves and their heirs and from the lawful claim of all persons whatsoever. In Testimoney whereof they the said party of the first part, have hereunto subscribed their names and affixed their seals the day and year before written John Mc Holmes Jerusia Holmes Commonwealth of Kentucky Pulaski County, towit, This day the above named Jerusha Holmes subscribed to the foregoing Deed of Conveyance personally appeared before us John Cowan and Joseph Porter, two of the Commonwealth Justices of the Peace for said County, and the said Jerusha being us examined separate and apart from her husband John Mc Holmes, did acknowledge the above Deed of Conveyance to be her voluntary act and deed, and that she freely relinquished all right, title and interest to the tract of land specified in the above deed of conveyance and that she has done it of her own free will without the threats or persuasion of her husband John Mc Holmes. Given under our hands as Justices as aforesaid this 29th day of September 1835. John W. Cowan, JP Jos Porter, JP Commonwealth of Kentucky Pulaski County, to wit, I William Fox, Clerk of the county court for the County aforesaid do certify that this Deed from John Mc Holmes and his wife Jerusia Holmes to John Baber was, this day produced to me in my office and acknowledged by the said, Johm Mc Holmes to be his act and deed. Whereupon the said Deed as also the certificate of the said Jerusia's relinquishment of Dower, together with the foregoing certificate, hath been duly admitted to record in my office.
