Will Bk C, pp 196, 197 MEDCALF; ABLE; LILLY; GLASS; CLARKE; BODINO; BOYLE; PAYNE; In the name of God, Amen I Charles MEDCALF of the City of Louisville in the State of Kentucky being of sound mind but knowing the uncertainty of Death do make this my last will and Testament. Having ____ Worldly goods with which it has pleased God to bless me I wish to dispose of them in the following manner Towit. Item 1st To my daughter Clementine ABLE I give and bequeath fifty acres of land lying in Nelson County, KY the same being apart of the LILLY tract and is now in her possession to have and to hold during her natural life and after death to be divided among her children. Item 2nd To my son Elisha MEDCALF I have deeded fifty acres of land the same being a part of the above mentioned tract and to him I now give and bequeath the balance of the said tract being twelve acres more or less, the same he lately sold to LILLY & ABLE. Item 3rd To my daughter Ann CLARKE I give and bequeath fifty acres land being the same more or less, being on the East side of the tract I late ly sold to A. BODINO the same that is now in her possession to have and to hold during her natural life and after her death to be equally divided among her children. Item 4th I will and direct that after my death any houses and lots in Louisville and all the real Estate I may have at my death I desire shall be sold in following manner one fourth cash in hand the balance as a credit of one and two years. Whatever other property I may have at my death I will to be sold on a credit of Twelve months. I will and direct that the proceeds from the sale of the above named property together with all my cash notes & bonds and effects of every kind and description be equally divided in the following manner Towit: To my daughter Elizabeth BOYLE one sixth part my daughter Mary PAYNE one sixth part my sons in law Alfred BOYLE and Lewis PAYNE one sixth part in trust for my daughter Harriet PHILPOT to be laid out for the purchase of a farm for the use of the said Harriet PHILPOT during her natural life and after her death to be equally divided among her children. To the children of my daughter Eleanor SMITH namely Harriet, Franklin, Susan, Maria, Catherine, Henrietta, Charles and John, one sixth part. To the children of my daughter Martha PAYNE namely John, Elizabeth, Harriet, Martha Ann, one sixth part. To the children of my daughter Matilda BOYLE namely Elenor, CHarles, Maime, Andrew, Elizabeth & James one sixth part to be paid over to then when collected by my executors. Item 4th I do hereby appoint my son in law Alfred BOYLE Executor of this my last will and Testament and I do hereby revoke and annul all the other wills heretofore made by me. This writing purporting to be the last will and Testament of Charles MEDCALF Dec'd was proved according to Law by the Oaths of Gilbert GLASS and Hendon MOREHEAD Witnesses thereto and is ordered to be recorded. And on the motion of Alfred BOYLL the Executor therein named who made oath therto and together with Gilbert GLASS, Mahlon SHIELDS and Hendon MOREHEAD his securities entered into and acknowledged a Bond in the penalty of $14000. conditioned as the law directs Certificate is granted him for obtaining a probate of the said will in due form.
